NATIONAL ARCHIVES (FEES) REGULATIONS, 1988.

The Taoiseach, in exercise of the powers conferred on him by section 19 (2) of the National Archives Act, 1986 (No. 11 of 1986), and with the consent of the Minister for Finance, hereby makes the following regulations:

1. (1) These Regulations may be cited as the National Archives (Fees) Regulations, 1988.

(2) These Regulations shall come into operation on the first day of June, 1988.

2. In these Regulations—

"the Act of 1986" means the National Archives Act, 1986 (No. 11 of 1986);

"the Director" means the Director of the National Archives;

"Department of State" has the same meaning as it has in section 1(2) (b) of the Act of 1986.

3. The fees specified in the Schedule to these Regulations shall be charges by the National Archives in respect of the matters specified therein.

4. Where copies of archives are sent by the National Archives by prepaid post to persons requesting them, then—

( a ) subject to paragraph 1 of the part II of the Schedule to these Regulations, a fee equal to the cost of such posting shall be charged by the National Archives in respect of the copies in addition to any fees which may be charged by virtue of Regulation 3 of these Regulations, or

( b ) If the request for the copies was sent to the National Archives by prepaid post and the fees chargeable by the National Archives under these Regulations would, apart from this paragraph, be less than £2 in total, a single fee of £2 shall be charged by the National Archives in respect of such copies in lieu of the said fees.

5. (1) When applications are made by any Department of State for copies or inspections of archives, the fees provided for by these Regulations shall not be charged.

(2) Where a person or a body (being a body corporate other than a Department of State or being an unincorporated body of persons) has either voluntarily or by virtue of any enactment deposited any documents or records (or any copies of them) with the National Archives, then, subject to any conditions to which section 4 (i) (f) of the Act of 1986 relates, the Director—

( a ) shall permit inspection of such documents or records (or such copies of them) to be made by the person or body (as the case may be) without charge, and

( b ) may, at his discretion, permit copies of such documents or records (or such copies of them) to be made and supplied to the person or body (as the case may be) without charge.

(3) The Director may, at his discretion, permit inspections of archives solely for the purposes of research to be made without charge.

(4) The Director may, where he considers it appropriate in exceptional circumstances, permit copies of archives to be made and supplied without charge.
