AQUACULTURE (INVER BAY, McSWYNE'S BAY) ORDER, 1987.

I, PADDY O`TOOLE, Minister for Tourism, Fisheries and Forestry, in exercise of the powers conferred on me by section 54 of the Fisheries Act, 1980 (No. 1 of 1980), as amended by section 5 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and by the Fisheries (Transfer of Departmental Administration and ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1986 ( S.I. No. 40 of 1986 )), having complied with the requirements of subsection (3) of the said section 54, and having considered a report made to me under subsection (4) of the said section 54, and being of the opinion that, notwithstanding the existence of any public right to fish in the waters to which the following order relates, it is in the public interest that the order be made, hereby with the consent of the Minister for Communications, order as follows:

1. This Order may be cited as the Aquaculture (Inver Bay, McSwyne's Bay) Order, 1987.

2. The areas described in the Schedule hereto is hereby designated to be an areas within which it shall be lawful to engage in aquaculture pursuant to and in accordance with a licence granted under section 54 of the Fisheries Act, 1980 (No. 1 of 1980).

SCHEDULE

A. All that area of Inver Bay and adjoining waters which is bordered by the high water mark and which is enclosed by a line drawn from the most westerly point of the high water mark of the townland of Fanaghans, barony of Ikeathy and Oughterany to the most westerly point of the high water mark of the townland of Raneely, barony of Banagh, all in the county of Donegal.

B. All that area of McSwyne's Bay, Richie's Bay and adjoining waters which is enclosed by a line drawn due west from the most southerly point of the high water mark of the townland of Rahan Near, barony of Banagh, county of Donegal, for a distance of 1,600 metres thence continuing at a bearing of 220° true for a distance of 1,700 metres and thence continuing to the most southerly point of the high water mark of Carntullagh Head, in the townland of Carntullagh, barony of Banagh, county of Donegal, and thence continuing along the high water mark, initially in an easterly direction, to the point first mentioned.

EXPLANATORY NOTE.
