ROAD TRAFFIC (LICENSING OF DRIVERS) (AMENDMENT) REGULATIONS, 1987.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 33 and 42 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Road Traffic (Licensing of Drivers) (Amendment) Regulations, 1987.

(2) These Regulations and the Road Traffic (Licensing of Drivers) Regulations, 1964 to 1986 shall be construed as one and may be cited together as the Road Traffic (Licensing of Drivers) Regulations, 1964 to 1987.

2. These Regulations shall come into operation on the 2nd day of November, 1987.

3. The Road Traffic (Licensing of Drivers) Regulations, 1964 ( S.I. No. 29 of 1964 ) are hereby amended by the substitution for article 27 of the following article—

"27. (1) Where a person does not submit to a test for a certificate of competency arranged pursuant to an application made by him, the fee paid may be refunded to him by the issuing authority—

( a ) where not later than seven days before the date arranged for the test the issuing authority receives from him notification of his decision not to submit to the test, or

( b ) where the issuing authority is satisfied that the applicant had adequate reason for not undergoing the test.

(2) Where a person does not submit to a test for a certificate of competency arranged pursuant to an application made by him and the fee paid by him in respect of such application is not refunded he shall, before submitting to a test for such a certificate, make a fresh application for a certificate unless—

( a ) not later than seven days before the date arranged for the test the issuing authority receives from him notification of his decision not to submit to the test, or

( b ) the issuing authority is satisfied that the applicant had adequate reason for not undergoing the test.".

EXPLANATORY NOTE

These Regulations re-state, with amendments, Article 27 of the Road Traffic (Licensing of Drivers) Regulations, 1964 principally to provide that an applicant for a driving test who wishes to cancel a test appointment must (except in exceptional circumstances) give a minimum of 7 days notice of such cancellation instead of 3 days as heretofore.
