CRIMINAL JUSTICE ACT, 1984 (COMMENCEMENT) ORDER, 1987.

WHEREAS the Garda Síochána (Complaints) Act, 1986 (No. 29 of 1986), came into operation on the 15th day of July, 1986, and pursuant to it, the Garda Síochána Complaints Board was established on the 6th day of April 1987:

AND WHEREAS that Act contains provisions relating to the investigation of complaints from the public against members (within the meaning of that Act) and the adjudication by a body other than the Garda Síochána of such complaints:

AND WHEREAS the Criminal Justice Act, 1984 (Treatment of Persons in Custody in Garda Síochána Stations) Regulations, 1987 ( S.I. No. 119 of 1987 ), were made under section 7 of the Criminal Justice Act, 1984 (No. 22 of 1984), and came into operation on the 16th day of May, 1987:

NOW, I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by section 1 (1) of the said Criminal Justice Act, 1984 , hereby order as follows:

1. This Order may be cited as the Criminal Justice Act, 1984 (Commencement) Order, 1987.

2. Sections 4 to 6, 8 to 10, 15, 16, 18 and 19 of the Criminal Justice Act, 1984 (No. 22 of 1984), shall come into operation on the 1st day of July, 1987.

EXPLANATORY NOTE.

This Order fixes 1 July, 1987 as the date on which the remaining sections of the Criminal Justice Act, 1984 shall come into operation, namely, those relating to detention after arrest for investigation of serious offences (sections 4 to 6 and 8 to 10), offences of withholding information about illegally held firearms and stolen property (sections 15 and 16) and drawing of inferences from an accused person's failure to account for certain objects, marks, etc. or for presence at or near scene of crime (sections 18 and 19).
