PROTECTION OF EMPLOYEES (EMPLOYERS' INSOLVENCY) (SPECIFICATION OF DATE) REGULATIONS, 1986.

I, RUAIRI QUINN, Minister for Labour, in exercise of the power conferred on me by section 4 (3) of the Protection of Employees (Employers' Insolvency) Act, 1984 (No. 21 of 1984), hereby make the following Regulations:

1. These Regulations may be cited as the Protection of Employees (Employers' Insolvency) (Specification of Date) Regulations, 1986.

2. In the case of an employer who is a company within the meaning of the Protection of Employees (Employers' Insolvency) Act, 1984 , by virtue of being a body corporate under the Industrial and Provident Societies Acts, 1893 to 1978, and which, by virtue of section 1 (3)(c) of the said Protection of Employees (Employers' Insolvency) Act, 1984 , has become insolvent as a result of the making of a winding up order or the passing of a resolution for voluntary winding up with respect to the said company, but not being a company within the meaning of section 2 of the Companies Act, 1963 , the day on which the winding up order was made or the resolution for voluntary winding up was passed is hereby specified as the day on which that employer is to be regarded as having become insolvent for the purposes of the said Protection of Employees (Employers' Insolvency) Act, 1984 .

EXPLANATORY NOTE.

The purpose of these Regulations is to specify the day on which a winding up order was made or the resolution for voluntary winding up was passed as being the day on which a body corporate under the Industrial and Provident Societies Acts, 1893 to 1978 is to be regarded as having become insolvent for the purposes of the Protection of Employees (Employers' Insolvency) Act, 1984 .
