ROAD TRAFFIC ACT, 1961 (SECTION 103) (OFFENCES) (AMENDMENT) REGULATIONS, 1986.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 103 of the Road Traffic Act, 1961 , (No. 24 of 1961) (as amended by sections 6 and 64 of the Road Traffic Act, 1968 (No. 25 of 1968) and section 74 of the Finance Act, 1976 (No. 16 of 1976)) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Road Traffic Act, 1961 (Section 103) (Offences) (Amendment) Regulations, 1986.

(2) These Regulations and the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 to 1985 shall be construed together as one and may be collectively cited as the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 to 1986.

2. In these Regulations:—

"the Principal Regulations" means the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 ( S.I. No. 188 of 1976 );

"the 1985 Regulations" means the Road Traffic Act, 1961 (Section 103) (Offences) (Amendment) Regulations, 1985 ( S.I. No. 255 of 1985 ).

3. Article 3 of the Principal Regulations is hereby amended by the addition after paragraph (4) of the following paragraphs—

"(5) an offence of contravening a regulation under section 11 of the Act requiring the carrying on a vehicle of an insurance disc in the prescribed form and manner;

(6) an offence under section 12 of the Act."

4. The following article is hereby substituted for article 5 of the Principal Regulations:—

"5. The prescribed amounts for the purposes of section 103 (2) (b) and of section 103 (3) (b) of the Act for offences declared by the Minister to be offences to which section 103 of the Act applies shall be——

(a) fifteen pounds in respect of the offence of stopping or parking during a clearway period on a part of a roadway which is a clearway in contravention of a bye-law or rule under section 89 or section 90 of the Act as amended by section 6 of the Road Traffic Act, 1968 ;

(b) fifteen pounds in respect of the offence of parking on a part of a roadway which is a bus lane in contravention of a bye-law or rule under section 90 of the Act as amended by section 6 of the Road Traffic Act, 1968 ;

(c) fifty pounds in respect of an offence of contravening a regulation under section 11 of the Act requiring the carrying on a vehicle of an insurance disc in the prescribed form and manner;

(d) fifty pounds in respect of an offence under section 12 of the Act;

(e) fifty pounds in respect of an offence under section 73 of the Finance Act, 1976 ; and

(f) ten pounds in respect of all other offences."

5. The First Schedule to the Principal Regulations as amended by article 4 of the 1985 Regulations is hereby amended by the substitution of the words "fifty pounds, fifteen pounds or ten pounds" for the words "fifteen pounds or ten pounds" in each case where they occur in the said Schedule.

6. These Regulations shall come into force on the 1st day of January, 1987.

EXPLANATORY NOTE.

These Regulations amend the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 to 1985 by adding the following offences to which section 103 of the Act applies

— failure to display an insurance disc in contravention of regulations made under section 11 of the Act; and

— overloading a vehicle in contravention of section 12 of the Act.

The Regulations provide that the amount which a person liable to prosecution for such offences, may pay as an alternative to the institution of a prosecution shall be £50.

The Regulations also increase from £15 to £50 the amount which a person liable to prosecution for the offence of non display of a tax disc may pay as an alternative to the institution of a prosecution.

The Regulations take effect from 1st January, 1987.
