AQUACULTURE (VENTRY HARBOUR AND TRABEG BAY) ORDER, 1986.

I, LIAM KAVANAGH, Minister for Tourism, Fisheries and Forestry, in exercise of the powers conferred on me by section 54 of the Fisheries Act, 1980 (No. 1 of 1980), as amended by section 5 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and by the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1986 ( S.I. No. 40 of 1986 )), having complied with the requirements of subsection (3) of the said section 54, and having considered a report made to me under subsection (4) of the said section 54, and being of the opinion that, notwithstanding the existence of any public right to fish in the waters to which the following order relates, it is in the public interest that the order be made, hereby, with the consent of the Minister for Communications, order as follows:

1. This Order may be cited as the Aquaculture (Ventry Harbour and Trabeg Bay) Order, 1986.

2. The areas described in paragraphs 1 and 2 of the Schedule hereto are hereby designated to be areas within which it shall be lawful to engage in aquaculture pursuant to and in accordance with a licence granted under section 54 of the Fisheries Act, 1980 (No. 1 of 1980).

SCHEDULE

1. All that area of Ventry Harbour and adjoining waters which is bordered by the high water mark and which lies north of a line drawn from the most easterly point of the high water mark of the townland of Kilfarnoge, barony of Corkaguiny, county of Kerry, to the most southerly point of the high water mark of the townland of Paddock, barony of Corkaguiny, county of Kerry.

2. All that area of Trabeg Bay and adjoining waters which is bordered by the high water mark and which lies north of a line drawn from the most southerly point of the high water mark of the townland of Beenbane, barony of Corkaguiny, county of Kerry, to the most westerly point of the high water mark of the townland of Doonties Commons, barony of Corkaguiny, county of Kerry.

EXPLANATORY NOTE.
