AQUACULTURE (KILKIERAN BAY) ORDER, 1986.

I, LIAM KAVANAGH, Minister for Tourism, Fisheries and Forestry, in exercise of the powers conferred on me by section 54 of the Fisheries Act, 1980 (No. 1 of 1980), as amended by section 5 of the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), and by the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1986 ( S.I. No. 40 of 1986 )), having complied with the requirements of subsection (3) of the said section 54, and having considered a report made to me under subsection (4) of the said section 54, and being of the opinion that, notwithstanding the existence of any public right to fish in the waters to which the following order relates, it is in the public interest that the order be made, hereby, with the consent of the Minister for Communications, order as follows:

1. This Order may be cited as the Aquaculture (Kilkieran Bay) Order, 1986.

2. The area described in the Schedule hereto is hereby designated to be an area within which it shall be lawful to engage in aquaculture pursuant to and in accordance with a licence granted under section 54 of the Fisheries Act, 1980 (No. 1 of 1980).

SCHEDULE

All that area of Kilkieran Bay and adjoining waters which is bordered by the high water mark and which is enclosed by a line drawn due south from the most southerly point of the high water mark in the townland of Keeraunbeg, barony of Moycullen, county of Galway, for a distance of 2,500m and thence continuing due west for a distance of 23,000m and thence continuing in a northerly direction to the most westerly point of the high water mark of St. Macdara's Island,barony of Ballynahinch, county of Galway, and continuing in a north-easterly direction to the most westerly point of the high water mark of the townland of Halfmace, barony of Ballynahinch, county of Galway.

EXPLANATORY NOTE.

This Order designates the area of Kilkieran Bay and adjoining waters as being an area within which it shall be lawful to engage in aquaculture pursuant to a licence issued by the Minister for Tourism, Fisheries and Forestry.
