CRIMINAL JUSTICE (LEGAL AID) (AMENDMENT) (No. 2) REGULATIONS, 1986.

I, ALAN M. DUKES, Minister for Justice, in exercise of the powers conferred on me by section 10 of the Criminal Justice (Legal Aid) Act, 1962 (No. 12 of 1962), and in so far as these Regulations are in relation to rates or scales of payment of fees, costs or expenses payable out of moneys provided by the Oireachtas pursuant to certificates for free legal aid, with the consent of the Minister for Finance, hereby makes the following Regulations:

1. (1) These Regulations may be cited as the Criminal Justice (Legal Aid) (Amendment) (No. 2) Regulations, 1986.

(2) The collective citation "the Criminal Justice (Legal Aid) Regulations, 1965 to 1986" shall include these Regulations.

2. In these Regulations "the Regulations of 1985" means the Criminal Justice (Legal Aid) (Amendment) Regulations, 1985 ( S.I. No. 225 of 1985 ).

3. Regulation 7 (as amended by the Regulations of 1985 and the Criminal Justice (Legal Aid) (Amendment) Regulations, 1986 ( S.I. No. 36 of 1986 )) of the Criminal Justice (Legal Aid) (Amendment) Regulations, 1975 ( S.I. No. 100 of 1975 ), is hereby amended—

(a) by the substitution of "£24.12" for "£23.42",

(b) by the substitution, with effect from the 1st day of January, 1987, of "£24.60" for "£24.12", and

(c) by the substitution, with effect from the 1st day of May, 1987, of "£25.10" for "£24.60".

4. Regulation 3(2)(a) (as amended by the Regulations of 1985) of the Criminal Justice (Legal Aid) (Amendment) Regulations, 1978 ( S.I. No. 33 of 1978 ), is hereby amended—

(a) by the substitution of "£46.53" for "£45.18" and of "£20.69" for "£20.09",

(b) by the substitution, with effect from the 1st day of January, 1987, of "£47.47" for "£46.53" and of "£21.10" for "£20.69", and

(c) by the substitution, with effect from the 1st day of May, 1987, of "£48.41" for "£47.47" and of "£21.53" for "£21.10".

EXPLANATORY NOTE.

These Regulations provide for an increase of 3% and further increases of 2% with effect from 1st January, 1987 and 2% with effect from 1st May, 1987 in the criminal legal aid fees payable to solicitors in respect of attendances in the District Court, appeals to the Circuit Court and visits to prisons and other custodial centres.
