ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF CARLOW) REGULATIONS, 1985.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Carlow) Regulations, 1985.

2 Commencement.

2. These Regulations shall come into operation on the 16th day of December, 1985.

3 Interpretation.

3. In these Regulations save where the context otherwise requires—

"the Act" means the Road Traffic Act, 1961 ;

"distance" means distance as measured along the centre line of the road.

"national road" means a road declared to be a national road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road as shown in Column 1 of the First Schedule or Column 1 of the Second Schedule to the aforementioned Order;

"road" means a public road;

"special speed limit" and "built-up area speed limit" have the meaning respectively assigned to them in Part IV of the Act;

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built.up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocations.

7. The Road Traffic (Speed Limits) (County of Carlow) Regulations, 1978 ( S.I. No. 121 of 1978 ) and the Road Traffic (Speed Limits) (County of Carlow) (Amendment) regulations, 1982 ( S.I. No. 72 of 1982 ) are hereby revoked.

FIRST SCHEDULE.

Roads in the County of Carlow declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Carlow:—

( a ) The road connecting the Athy Road with the Dublin Road (National Road N9) between the urban district boundary and its junction with the Dublin Road (National Road N9).

( b ) The Oak Park Road between the urban district boundary and its junction with the road connecting the Athy Road with the Dublin Road (National Road N9).

( c ) The Rathvilly Road between the point where the urban district boundary intersects the southern side of the road and its junction with the industrial estate road.

( d ) The Palatine Road between its junction with the Rathvilly Road and the point where the urban district boundary intersects the western side of the road.

( e ) The Browneshill Road between the urban district boundary and a point 23 metres south-east of its junction with Talbot Terrace.

(f) The Tullow Road (National Road N80) between the urban district boundary and a point 228 metres south-east of its junction with the Browneshill Road.

( g ) The Monacurragh Road between the point where the urban district boundary intersects the western side of the road and a point 640 metres south of its junction with the Hanover Road.

2. The following roads in the town of Maine Bheag:

( a ) The Green Road, The Old Carlow Road.

( b ) The Royal Oak Road for a distance of 620 metres from the town boundary.

( c ) The Leighlinbridge Road for a distance of 1, 245 metres from the point where the town boundary intersects the south-western side of the road.

SECOND SCHEDULE.

Roads in the County of Carlow declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Ballon:

( a ) The Carlow-Bunclody road (National Road N80) between a point 247 metres north-west of its junction with the Tullow Road and a point 174 metres east of its junction with the Myshall Road.

( b ) The Tullow Road for a distance of 69 metres from its junction with the Carlow-Bunclody road (National Road N80).

( c ) The Muine Bheag Road for a distance of 183 metres from its junction with the Carlow-Bunclody road (National Road N80).

( d ) The Myshall Road for a distance of 183 metres from its junction with the Carlow-Bunclody road (National Road N80).

( e ) The Ballon Hill Road for a distance of 275 metres from its junction with the Carlow-Bunclody road (National Road N80).

2. The following roads at Ballymurphy:

( a ) The Borris-Kiltealy road between a point 66 metres south-east of its junction with the Tinnahinch Road and a point 80 metres north-east of its junction with the Coonogue Road.

( b ) The Coonogue Road for a distance of 160 metres from its junction with the Borris-Kiltealy road.

( c ) The Glynn Road for a distance of 195 metres from its junction with the Borris-Kiltealy road.

3. The following roads at Borris:

( a ) The Muine Bheag-Tinnahinch road between a point 67 metres south-east of its junction with the Goresbridge Road and a point 23 metres morth-west of its northernmost junction with the Rathanna Road.

( b ) The Fenagh Road for a distance of 137 metres from its junction with the Muine Bheag-Tinnahinch road.

4. The following roads at Bunclody (Carrickduff):

( a ) St. Brigid's Terrace, Oliver Plunkett Park Housing estate roads.

( b ) The Carrickduff Road between a point 110 metres north-west of its junction with St. Brigid's Terrace and the boundary between the counties of Wexford and Carlow at Clody Bridge.

( c ) The Borris Road for a distance of 255 metres from its junction with the Carrickduff Road.

5. The following roads at Clonegal:

( a ) St. Brigid's Terrace.

( b ) The Tullow Road between the boundary between the counties of Carlow and Wexford and a point 470 metres north of its junction with the Carnew Road.

( c ) The Carnew Road for a distance of 355 metres from its junction with the Tullow Road.

( d ) The Carlow Road between its junction with the Tullow Road and a point 110 metres west of its junction with the Clongarron Road.

( e ) The Clongarron Road for a distance of 240 metres from its junction with the Carlow Road.

( f ) The road connecting the Clongarron Road with the Tullow Road.

6. The following roads at Fenagh:

( a ) The Muine Bheag-Carlow road between its junction with the Borris Road and a point 30 metres south-west of its junction with the Myshall Road.

( b ) The roads in the new County Council Housing Estate.

7. The following road at Goresbridge:—

The Borris Road for a distance of 150 metres from the boundary between the counties of Kilkenny and Carlow.

8. The following roads at Hacketstown:

( a ) Marian Terrace, Pennyhill, Water Lane.

( b ) The Tinahely-Baltinglass road between a point 46 metres south-east of its junction with the Ballysallagh Road and a point 201 metres north-west of its junction with Pennyhill.

( c ) Mill Lane and its continuation as the Knockananna Road for a distance of 233 metres from the junction of Mill Lane with the Tinahely-Baltinglass road.

( d ) Moffat Lane and its continuation as the Tullow Road to a point 92 metres west of the junction of the Tullow Road with Pennyhill.

( e ) Slate Row and its continuation as the Clonmore Road for a distance of 320 metres from the junction of Slate Row with Moffat Lane.

(f) The Ballysallagh Road for a distance of 46 metres from its junction with the Tinahely-Baltinglass road.

9. The following roads at Kildavin:

( a ) The Carlow-Bunclody road (National Road N80) between a point 180 metres north-west of its junction with the Myshall Road and a point 220 metres south-east of the said junction.

( b ) The Myshall Road for a distance of 140 metres from its junction with the Carlow-Bunclody road (National Road N80).

( c ) The Clonegal Road for a distance of 270 metres from its junction with the Carlow-Bunclody road (National Road N80).

10. The following roads at Leighlinbridge;—

All roads in the area enclosed by a line commencing at a point on the Carlow Road (National Road N9) 274 metres north-east of the junction of Carlow Street with Tullow Street and drawn thence in straight lines successively to the following points:—

( a ) a point on Tullow Street 201 metres north-east of its junction with Carlow Street,

( b ) a point on the Muine Bheag Road 347 metres southeast of the junction of High Street with Carlow Street,

( c ) a point on the Kilkenny Road (National Road N9) 541 metres south-west of the junction of Church Street with St. Lazerian's Street,

( d ) a point on Old Leighlin Road 274 metres south-west of its junction with Seskin Road,

( e ) a point on the Seskin Road 366 metres northwest of its junction with St. Lazerian's Street.

( f ) a point on Milford Street 137 metres north of its junction with St. Lazerian's Street,

and from the last mentioned point in a straight line to the commencement point on the Carlow Road (National Road N9).

11. The following roads adjacent to the town of Muine Bheag:—

( a ) Philip Street between its junction with the Corries Road and the boundary of the town of Muine Bheag.

( b ) Kilcarrig Street and its continuation as Kilcarrig Road between the boundary of the town of Muine Bheag and a point 85 metres south-east of the said boundary.

( c ) The Fenagh Road for a distance of 140 metres from its Junction with the Kilcarrig Road.

12. The following roads at Myshall:—

All roads in the area enclosed by a line commencing at a point on the Bunclody Road 210 metres south-east of its junction with the Ballykeenan Road and drawn thence in straight lines successively to the following points:—

( a ) The southernmost point of the cul-de-sac road leading to the Catholic Church,

( b ) a point on the Muine Bheag Road 244 metres west of its junction with the cul-de-sac leading to the Catholic Church,

( c ) a point on the Fenagh Road 300 metres north-west of the entrance to the County Council Housing Estate,

( d ) a point on the Ballykeenan Road 360 metres north-east of its junction with the Bunclody Road

and from the last mentioned point in a straight line to the commencement point on the Bunclody Road.

13. The following road at Palatine:—

The Carlow Road for a distance of 580 metres from the boundary between the counties of Kildare and Carlow at Palatine Bridge.

14. The following roads at Raheendoran:—

( a ) The Carlow-Ballinabranagh road between a point 300 metres south of its junction with the Bilboa Road and a point 625 metres north-east of the said junction.

( b ) The Bilboa Road for a distance of 255 metres from its junction with the Carlow-Ballinabranagh road.

15. The following roads at Rathoe:—

( a ) The Leighlinbridge-Tullow road between a point 95 metres west of its junction with the Ballon Road and a point 95 metres east of the said junction.

( b ) The Ballon Road for a distance of 380 metres from its junction with the Leighlinbridge-Tullow road.

( c ) The Housing Estate Road leading west of the Ballon Road.

16. The following roads at Rathvilly:—

( a ) Michael Collins Park, Ballyoliver housing scheme road.

( b ) The Baltinglass-Hacketstown road between a point 105 metres south-east of its junction with the Carlow Road and a point 40 metres east of its junction with the Lisnavagh Road.

( c ) The Tullow Road for a distance of 930 metres from its junction with the Baltinglass-Hacketstown road.

( d ) The Lisnavagh Road for a distance of 40 metres from its junction with the Hacketstown Road.

17. The following roads at Royal Oak:—

( a ) The old Carlow-Kilkenny road between a point 180 metres north-east of its junction with the Muine Bheag Road and a point 340 metres south-west of the said junction.

( b ) The Muine Bheag Road for a distance of 235 metres from its junction with the old Carlow-Kilkenny road.

( c ) The Moanmore Road for a distance of 60 metres from its junction with the old Carlow-Kilkenny road.

( d ) The Fenniscourt Road for a distance of 60 metres from its junction with the old Carlow-Kilkenny road.

18. The following roads at St. Mullin's:—

( a ) The Graiguenamanagh-New Ross road between a point 30 metres south-west of its junction with the Glynn Road and a point 245 metres east of its junction with the Green.

( b ) The road connecting the quay at Bauck with the New Ross Road for a distance of 180 metres from its junction with the quay at Bauck.

( c ) The road at the Green leading from the Graiguenamanagh Road, first in a south-westerly direction to the Post Office and thence in a south-easterly direction, to the New Ross Road.

( d ) The road connecting the Graiguenamanagh-New Ross road with the quay at St. Mullins.

19. The following roads at Tinnahinch:

( a ) St. Michael's Terrace.

( b ) The Graiguenamanagh-Carlow road for a distance of 275 metres from the boundary between the counties of Kilkenny and Carlow.

( c ) The St. Mullin's Road for a distance of 661 metres from its junction with the Graiguenamanagh-Carlow road.

( d ) The roads in the County Council housing estate off St. Mullin's Road.

20. The following roads at Tinryland:

( a ) The Carlow-Nurney road between a point 115 metres north of its junction with the road leading to Tinryland Crossroads and a point 420 metres south of said junction.

( b ) The road leading to Tinryland crossroads for a distance of 70 metres from its junction with the Carlow-Nurney road.

( c ) The roads in the new County Council Housing Estate.

21. The following roads at Tullow:

All roads in the area enclosed by a line commencing at a point on the Dublin Road (National Road N81) 458 metres north-east of its junction with the Shillelagh Road and drawn thence in straight lines successively to the following points:

( a ) a point on the Shillelagh Road 950 metres north-east of its junction with the Dublin Road (National Road N81);

( b ) a point on the Shroughawn Road 48 metres south-east of its junction with Crosskeys;

( c ) a point on Mill Street 650 metres south-east of its junction with Market Square;

( d ) a point on the Bunclody Road (National Road N81) 1,140 metres south-west of the junction of Abbey Street with Tullowbeg Street;

( e ) a point on the Templeowen Road 250 metres north-west of its junction with the Bunclody Road (National Road N81);

( f ) a point on Tullowbeg Street 338 metres north-west of its junction with Abbey Street;

( g ) a point on Barrack Street 360 metres north-west of its junction with Market Square and from the last mentioned point in a straight line to the commencement point on the Dublin Road (National Road N81).

THIRD SCHEDULE

Roads in the County of Carlow in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads in and adjacent to the Urban District of Carlow:

( a ) The Athy Road for a distance of 1,900 metres north-west of the boundary of the urban district of Carlow.

( b ) The road connecting the Athy Road with the Dublin Road (National Road N9).

( c ) The Rathvilly Road between its junction with the industrial estate road and a point 50 metres east of its junction with the road connecting the Rathvilly Road with the Browneshill Road.

( d ) The Palatine Road for a distance of 1, 080 metres from its junction with the Rathvilly Road.

( e ) The Tullow Road (National Road N80) between a point 228 metres south-east of its junction with the Browneshill Road and a point 69 metres south-east of its function with the Bunclody Road (National Road N80).

( f ) The Bunclody Road (National Road N80) for a distance of 183 metres from its junction with the Tullow Road.

( g ) The road connecting the Tullow Road (National Road N80) with the Rathvilly Road.

( h ) The Oak Park Road between its junction with the road connecting the Athy Road with the Dublin Road (National Road N9) and a point 91 metres north-east of its junction with the road to the Agricultural Institute.

( i ) The Browneshill Road between a point 23 metres south-east of its junction with Talbot Terrace and a point 60 metres east of its junction with the road connecting the Browneshill Road with the Tullow Road.

2. The following road at Mortarstown:

The Carlow-Kilkenny road (National Road N9) between a point 1,000 metres south-west of the boundary of the urban district of Carlow and a point 1,625 metres south-west of the said boundary.

3. The following roads in and adjacent to the town of Muine Bheag:

( a ) The Old Carlow Road for a distance of 50 metres from its junction with the Leighlinbridge Road.

( b ) The Leighlinbridge Road between a point 1,245 metres south-east of the point where the boundary of the town of Muine Bheag intersects the south-western side of the road and a point 325 metres south-east of the said intersection.

( c ) The Royal Oak Road between a point 620 metres south-east of the boundary of the town of Muine Bheag and a point 235 metres south-east of its junction with the Old Carlow-Kilkenny road.

4. The following roads at Tullow:

( a ) Tullowbeg Street and its continuation as the Carlow Road between a point 338 metres north-west of its junction with Abbey Street and a point 125 metres west of its junction with the Castledermot Road.

( b ) The Castledermot Road for a distance of 870 metres from its junction with the Carlow Road.

EXPLANATORY NOTE

These Regulations replace the Road Traffic (Speed Limits) (County of Carlow) Regulations, 1978 [ S.I. No. 121 of 1978 ) and the Road Traffic (Speed Limits) (County of Carlow) (Amendment) Regulations, 1982 ( S.I. No. 72 of 1982 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to be subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Siochana vehicles while being used in the course of duty are exempt from all speed limits by the Regulations.
