SOCIAL WELFARE (TEMPORARY PROVISIONS) REGULATIONS, 1985.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 3 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981) and section 308 of the said Act as amended by section 9 of the Social Welfare Act, 1982 (No. 2 of 1982), hereby makes the following regulations:—

1. These Regulations may be cited as the Social Welfare (Temporary Provisions) Regulations, 1985.

2. Where a person is or becomes entitled to payment of any of the following pensions, benefits, allowances or assistance under the Social Welfare Acts 1981 to 1985:—

( a ) disablement pension,

( b ) death benefit by way of pension,

( c ) old age (contributory) pension,

( d ) retirement pension,

( e ) survivor's benefit under section 87,

( f ) invalidity pension,

( g ) deserted wife's benefit,

( h ) widow's (contributory) pension,

( i ) orphan's (contributory) allowance,

( j ) old age pension,

( k ) blind pension,

( l ) widow's (non-contributory) pension,

( m ) orphan's (non-contributory) pension,

( n ) deserted wife's allowance,

( o ) prisoner's wife's allowance,

( p ) social assistance allowance,

( q ) single woman's allowance

( r ) unemployment assistance at the rates mentioned in paragraphs 1.A (1) and 1.B (1) of the Fourth Schedule

in respect of the week commencing on—

(i) the 5th day of December, 1985 in the case of a pension, benefit, allowance, mentioned at paragraph (d), (f), (g), (n), (o), (p), or (q) of this article, or

(ii) the 6th day of December, 1985 in the case of a pension, benefit, allowance, mentioned at paragraph (a), (b), (c), (e), (h), (i), (j), (k), (l) or (m) of this article.

(iii) the 27th day of November, in the case of assistance mentioned at paragraph (r) of this article,

any amount payable to him by way of that pension, benefit, allowance or assistance (including any increases) for the appropriate week shall be increased by a sum equal to 75 per cent. of that amount.

3. Where the increased rate of pension, benefit, allowance or assistance payable to a person under these Regulations includes an amount which is less than a multiple of five pence, such amount shall be rounded to the nearest multiple of five pence.

EXPLANATORY NOTE.

These Regulations provide for an increase in the weekly payment for long-term social welfare recipients in the week ending 6 December 1985.

The provision to increase by 75% the weekly amount in payment, including any increases for dependants, applies to recipients of disablement pension, death benefit by way of pension, old age (contributory) pension, retirement pension, survivors benefit under section 87, invalidity pension, deserted wife's benefit, widow's (contributory) pension, orphan's (contributory) allowance, old age (non-contributory) pension, blind pension, widow's (non-contributory) pension, orphan's (non-contributory) pension, deserted wife's allowance, prisoners wife's allowance, social assistance allowance, single woman's allowance and unemployment assistance at the long-term rate.
