LOCAL AUTHORITIES (TRAFFIC WARDENS) ACT, 1975 (SECTION 3) (OFFENCES) (AMENDMENT) REGULATIONS, 1985.

The Minister for the Environment in exercise of the powers conferred on him by subsections (1) and (6) of section 3 and section 6 of the Local Authorities (Traffic Wardens) Act, 1975 (No. 14 of 1975) (as amended by section 74 of the Finance Act, 1976 (No. 16 of 1976)) and after consultation with the Minister for Justice hereby makes the following Regulations:

1. (1) These Regulations may be cited as the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) (Amendment) Regulations, 1985.

(2) The Principal Regulations, the 1976 Regulations, the 1979 Regulations and these Regulations shall be construed together as one and may be collectively cited as the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) Regulations, 1975 to 1985.

2. In these Regulations:

"the Principal Regulations" means the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) regulations, 1975 ( S.I. No. 261 of 1975 );

"the 1976 Regulations" means the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) (Amendment) Regulations, 1976 ( S.I. No. 187 of 1976 );

"the 1979 Regulations" means the Local Authorities (Traffic Wardens) Act, 1975 (Section 3) (Offences) (Amendment) Regulations, 1979 ( S.I. No. 168 of 1979 ).

3. Sub-article (4) of article 3 of the Principal Regulations is hereby revoked.

4. The following article is hereby substituted for article 5 of the Principal Regulations (as amended by article 4 of the 1976 Regulations and by article 3 (1) of the 1979 Regulations):

"5. The prescribed amounts for the purposes of section 3 (2) (b) and of section 3 (3) (b) of the Act for offences declared by the Minister to be offences to which section 3 of the Act applies shall be—

( a ) fifteen pounds in respect of the offence of stopping or parking during a clearway period on a part of a roadway which is a clearway in contravention of a bye-law or rule under section 89 or section 90 of the Road Traffic Act, 1961 (as amended by section 6 of the Road Traffic Act, 1968 ),

(b) fifteen pounds in respect of the offence of parking on a part of a roadway which is a bus lane in contravention of a bye-law or rule under section 90 of the Act (as amended by section 6 of the Road Traffic Act, 1968 ),

(c) fifteen pounds in respect of an offence under section 73 of the Finance Act, 1976 , and

(d) ten pounds in respect of all other offences."

5. The Schedule to the Principal Regulations as amended by article 3 (2) of the 1979 Regulations is hereby amended by the substitution of the words "fifteen pounds or ten pounds" for the words "seven pounds or five pounds" in each case where they occur in the said Schedule.

6. These Regulations shall come into force on the 2nd day of September, 1985.

EXPLANATORY NOTE.

These Regulations further amend the Traffic Wardens Act, 1975 (Section 3) (Offences) Regulations, 1975, by increasing, with effect from 2nd September, 1985, the amount which a person liable to prosecution for an offence to which section 3 of the Act applies may pay as an alternative to the institution of a prosecution, as follows:

£10 (from £5) in respect of a parking offence,

£15 (from £5) in respect of the offence of non-display of a tax disc,

£15 (from £7) in respect of a clearway offence,

£15 (from £5) in respect of the offence of parking in a bus lane.
