EUROPEAN COMMUNITIES (PROHIBITION OF CERTAIN ACTIVE SUBSTANCES IN PLANT PROTECTION PRODUCTS) (AMENDMENT) REGULATIONS, 1984.

I, AUSTIN DEASY, Minister for Agriculture, it appearing to me to be necessary, because of an unforeseeable danger threatening plant production which cannot be contained by other means, to use a plant protection product referred to in Article 7 of the Council Directive 79/117/EEC of 21 December, 1978(1), for the purpose of giving effect to a derogation under the said Article 7, hereby in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Prohibition of Certain Active Substances in Plant protection Products) (Amendment) Regulations, 1984.

(2) These Regulations shall cease to have effect on the 1 day of November, 1984.

2. Notwithstanding Regulation 3(1) of the European Communities (Prohibition of Certain Active Substances in Plant Protection Products) Regulations, 1981 ( S.I. No. 320 of 1981 ), the following are hereby permitted:

( a ) the use of aldrin (being a substance mentioned in Part I of the Schedule to those Regulations) to control an outbreak of vine weevil (Otiorrhynchus species) which, immediately before the commencement of these Regulations, existed in the townlands of Ballykelly, Killiane Little and Sheepwalk in the county of Wexford and threatened the production of soft fruit in those townlands, and

( b ) the supply, by a person approved of for the purpose of this Regulation by the Minister for Agriculture, of aldrin for the use described in paragraph (a) of this Regulation.

EXPLANATORY NOTE.

The Regulations amend the European Communities (Prohibition of Certain Active Substances in Plant Protection Products) Regulations, 1981 to permit the immediate and controlled supply and use of aldrin to control a severe attack of vine weevil on gooseberries and blackcurrants on a farm in County Wexford. Treatment must be undertaken as a matter of urgency to prevent the spread of the larvae to a stage where they will no longer be susceptible to chemicals. Unless controlled now the pest will wipe out the fruit plantation within 9 months.
