WIRELESS TELEGRAPHY (BUSINESS RADIO LICENCE) (AMENDMENT) REGULATIONS, 1983.

I, JIM MITCHELL, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by section 6 (1) of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), and with the consent of the Minister for Finance, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Wireless Telegraphy (Business Radio Licence) (Amendment) Regulations, 1983.

(2) The Wireless Telegraphy (Business Radio Licence) Regulations, 1949 to 1982, and these Regulations may be cited together as the Wireless Telegraphy (Business Radio Licence) Regulations, 1949 to 1983.

(3) The Regulations shall come into operation on the 1st day of April, 1983.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

"the Regulations of 1949" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1949 ( S.I. No. 320 of 1949 );

"the Regulations of 1956" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1956 ( S.I. No. 2 of 1956 );

"the Regulations of 1957" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1957 ( S.I. No. 181 of 1957 );

"the Regulations of 1982" means the Wireless Telegraphy (Business Radio Licence) (Amendment) Regulations, 1982 ( S.I. No. 73 of 1982 ).

4. Paragraph (1) of Regulation 9 of the Regulations of 1949, inserted by Regulation 4 of the Regulations of 1956 and amended by Regulation 4 of the Regulations of 1982, is hereby amended by—

( a ) the substitution of "eleven pounds and fifty new pence" for "ten pounds" in both places where it occurs in subparagraph (a);

( b ) the substitution of "eleven pounds and fifty new pence", "eleven pounds and fifty new pence", and "forty pounds" for "ten pounds", "ten pounds" and "thirty six pounds", respectively, in subparagraph (b);

( c ) the substitution of "fifty four pounds" and "eleven pounds and fifty new pence" for "forty eight pounds" and "ten pounds", respectively, in subparagraph (c);

( d ) the substitution of "fifty four pounds", "eleven pounds and fifty new pence" and "forty pounds" for "forty eight pounds", "ten pounds" and "thirty six pounds", respectively, in subparagraph (d);

and the said paragraph (1), as so amended, is set out in the Table to this Regulation.

TABLE

(1) A fee shall be payable on the issue and on each renewal of a business radio licence and such fee shall be calculated on the following basis:

( a ) system comprising base and mobile stations only or system comprising mobile stations only: a fixed sum of eleven pounds and fifty new pence plus eleven pounds and fifty new pence for each station,

( b ) system comprising base, repeater and mobile stations or mobile and repeater stations: a fixed sum of eleven pounds and fifty new pence plus eleven pounds and fifty new pence for each base station and each mobile station plus forty pounds in respect of each repeater station,

( c ) system comprising two fixed stations only, that is to say, a fixed point to point system: a fixed sum of fifty four pounds plus eleven pounds and fifty new pence for each station,

( d ) system comprising two fixed stations with repeater stations, that is to say, a fixed point to point system with repeater stations: a fixed sum of fifty four pounds plus eleven pounds and fifty new pence for each fixed station plus forty pounds in respect of each repeater station.

5. Regulation 7 of the Regulations of 1956, as amended by Regulation 5 of the Regulations of 1982, is hereby amended by—

( a ) the substitution of "seven pounds" for "six pounds" in both places where it occurs in paragraph (a);

( b ) the substitution of "seven pounds" for "six pounds" in both places where it occurs and of "twenty seven pounds" for "twenty four pounds" in paragraph (b);

( c ) the substitution of "thirty four pounds" and "seven pounds" for "thirty pounds" and "six pounds", respectively, in paragraph (c); and

( d ) the substitution of "thirty four pounds", "seven pounds" and "twenty seven pounds" for "thirty pounds", "six pounds" and "twenty four pounds", respectively, in paragraph (d);

and the said Regulation 7, as so amended, is set out in the Table to this Regulation.

( c ) system comprising two fixed stations only, that is to say, a fixed point-to-point system: a fixed sum of thirty four pounds plus seven pounds for each station,

( d ) system comprising two fixed stations with repeater stations, that is to say, a fixed point-to-point system with repeater stations: a fixed sum of thirty four pounds plus seven pounds for each fixed station plus twenty seven pounds in respect of each repeater station.
