SUPREME COURT AND HIGH COURT (FEES) ORDER, 1983.

I, MICHAEL NOONAN, Minister for Justice, in exercise of the powers conferred on me by section 65 of the Courts of Justice Act, 1936 (No. 48 of 1936), and with the consent of the Minister for Finance, hereby order as follows:

1. This Order may be cited as the Supreme Court and High Court (Fees) Order, 1983.

2. This Order shall come into operation on the 1st day of August, 1983.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. In this Order, "the Principal Order" means the Supreme Court and High Court (Fees) Order, 1982 ( S.I. No. 43 of 1982 ).

5. The following article is hereby substituted for article 8 of the Principal Order:

"8. No fee shall be payable in the Central Office or in the Office of the Registrar of the Supreme Court on any application, order, judgment or report or on the filing of any notice of motion, affidavit or other document necessary in connection with habeas corpus proceedings, proceedings under the Extradition Act, 1965 (No. 17 of 1965), bail proceedings or proceedings in a criminal case by way of certiorari or mandamus.".

6. The following is hereby substituted for Item 45 in Part III of the Schedule to the Principal Order:

"45. On a memorandum for the registration of—

(a) a decree of the District Court

£3.00

The memorandum

(b) a judgement of the Circuit Court

£4.00

The memorandum

(c) a judgement of the High Court

£6.00

The memorandum.

".

7. The following are hereby substituted for Items 57 and 58 in Part III of the Schedule to the Principal Order:

"57. On a certificate at the foot of a memorandum for the registration or satisfaction of a judgment or decree, for the registration or vacate of a lis pendens, or for the vacate of a recognisance or bond

£1.00

The memorandum.

58. On a memorial of assignment of a judgment or decree

£6.00

The memorial."

EXPLANATORY NOTE.

This Order, which comes into operation on 1st August, 1983, provides that appropriate fees will be payable in relation to proceedings under the Guardianship of Infants Act, 1964 (No. 7 of 1964) and prescribes fees in relation to the registration of decrees of the District Court in the Central Office of the High Court.
