S.I. No. 347/1982 - Coras Iompair Éireann Salaried Officers' and Clerks' (G.N.R., C.D.R. and I.R.C.H.) Superannuation Scheme, 1977 (Amendment) Scheme, 1982 (Confirmation) (No. 2) Order, 1982.


I, JOHN P. WILSON, Minister for Transport, in exercise of the powers conferred on me by Rule 41 (2) of the Coras Iompair Éireann Salaried Officers' and Clerks' (G.N.R., C.D.R. and I.R.C.H.) Superannuation Scheme, 1977, and section 44 of the Transport Act, 1950 (No. 12 of 1950), as adapted by the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration) of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), hereby, after consultation with the Minister for the Public Service, order as follows:—

1. This Order may be cited as the Coras Iompair Éireann Salaried Officers' and Clerks' (G.N.R., C.D.R. and I.R.C.H.) Superannuation Scheme, 1977 (Amendment) Scheme, 1982 (Confirmation) (No. 2) Order, 1982.

2. The scheme set out in the Schedule to this Order (being a scheme submitted by the Board under Rule 41 (1) of the Coras Iompair Éireann Salaried Officers' and Clerks' (G.N.R., C.D.R. and I.R.C.H.) Superannuation Scheme, 1977 and amending that scheme) is hereby confirmed, and shall be deemed to have come into operation on the 1st day of January, 1978.

SCHEDULE.

CORAS IOMPAIR ÉIREANN SALARIED OFFICERS' AND CLERKS' (G.N.R., C.D.R AND I.R.C.H.) SUPERANNUATION SCHEME, 1977 (AMENDMENT) SCHEME, 1982.

1. Interpretation:

In this amending Scheme the following words and expressions shall have the meanings hereby assigned to them unless there is something inconsistent in the subject matter or the context repugnant to such construction:—

"the existing Scheme" means the Coras Iompair Éireann Salaried Officers' and Clerks' (G.N.R., C.D.R. and I.R.C.H.) Superannuation Scheme, 1977 confirmed by Statutory Instrument No. 339 of 1978 and subsequently amended by the amending Superannuation Scheme confirmed by Statutory Instrument No. 184 of 1982 .

"this Scheme" means the existing Scheme as hereby amended.

"operative date" means the 1st day of January, 1978.

"particular female member" means a female member who was in the employment of the Board on the operative date and who did not exercise the option presented by the Board to be subject to a normal retirement age of 60/65 years of age but excluding any female member who attained the age of 60 years prior to the 2nd April, 1981 and remained in the unbroken employment of the Board after attaining that age.

2. In this amending Scheme unless otherwise expressly stated words and expressions used shall have the meanings assigned to them by the existing Scheme.

3. Amendment of the Existing Scheme:

The existing Scheme shall be amended with effect on and from the operative date so as to conform with the provisions hereinafter contained and every provision of the existing Scheme which is inconsistent with the provisions hereinafter contained shall cease to have effect.

4. The first paragraph of Rule 23 shall be deleted and the following shall be substituted therefor:—

(1) In the application of the provisions of the Scheme to particular female members the expression "55 years" shall be substituted for the expression "60 years" wherever the latter appears and the Table below set forth shall be substituted for any other Table of minimum annuities in this Scheme.

The following paragraph shall be inserted in Rule 23 to follow the Table of the existing Scheme:

(2) Except in matters affected by the age of a particular female member the provisions of this Scheme shall be applied to female members in the same manner as they are applied to other members and notwithstanding Rule 2.1 of this Scheme and for greater certainty it is declared that the words "wife", "widow" and "widower" where these are used shall mean a spouse or deceased spouse of either sex as the case may be.

5. In Clause (1) of Rule 27 delete the parenthesis and the words in parenthesis. After the words "the age of 60 years" insert "(between 50 years and 55 years of age in the case of a particular female member)".

6. The word "male" shall be deleted where it appears in paragraphs (i) and (ii) of Clause (3) of Rule 29 and the words "a particular female member" shall be substituted for the words "female member" wherever they appear in Rule 29.

7. Rule 29 shall be amended by the deletion of paragraph (i) of Clause (10) and the substitution of the following therefor:—

(i) "If the Joint Annuitant dies before the critical date or if the Member leaves the service under Rule 28 before attaining the age of 60 years, or 55 years in the case of a particular female member, the exercise of the option shall automatically be revoked;"

8. In Clause (12) of Rule 30 "particular female members" shall be substituted for "female members".

9. The word "male" where it appears in sub-paragraphs (a) and (b) of Paragraph (i) of Clause (2) of Rule 35 shall be deleted.

EXPLANATORY NOTE.

The purpose of the scheme is to provide for the bringing into line of the retiring ages of female members with those of male members and for the application of the provisions of the scheme equally to male and female members.
