DUBLIN PILOTAGE ORDER, 1925 (AMENDMENT) ORDER, 1982.

WHEREAS the Dublin Port and Docks Board, as the Pilotage Authority for the Dublin Pilotage District, has applied in writing to the Minister for Transport for the making of a pilotage order in relation to the Dublin Pilotage District;

NOW I, Patrick Cooney, Minister for Transport, in exercise of the powers conferred on me by section 7 of the Pilotage Act, 1913, the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), hereby order as follows:

1. This Order may be cited as the Dublin Pilotage Order, 1925 (Amendment) Order, 1982.

2. This Order shall come into operation on the 26th day of February, 1982.

3. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

4. In this Order "the Principal Order" means the Dublin Pilotage Order, 1925, being the Order contained in the Schedule to the Pilotage Order Confirmation Act, 1926 (No. 1 (Private) of 1926).

5. In this Order "the 1963 Order" means the Dublin Pilotage Order, 1925 (Amendment) Order, 1963 ( S.I. No. 24 of 1963 ).

6. The Principal Order, the 1963 Order and this Order shall be construed together as one Order.

7. The Principal Order, as amended by the 1963 Order, is hereby amended by—

( a ) the substitution for paragraphs (a) and (b) of Article 4 thereof of the following paragraphs:—

"( a ) Six members appointed by the Authority from among their own members of whom one shall be nominated as Chairman and of whom not less than two shall be elected members of the Authority.

( b ) Three members (hereinafter referred to as Pilot-members) elected in manner hereinafter provided by the pilots licensed for the Pilotage District (hereinafter referred to as licensed pilots) from among persons who either are or have been licensed pilots within the period of five years immediately preceding the date of election.",

( b ) the substitution for sub-paragraphs (3) and (4) of paragraph 2 of the Schedule thereto of the following sub-paragraphs:—

"(3) Every licensed pilot shall be entitled to vote for three persons whose names are on the said list but shall not give more than one vote for any one person.

(4) At the expiration of twenty-one days from the issue of the said circular the said Secretary shall examine the said voting cards returned to him and shall prepare a list in order of the three persons who have received the greatest number of votes (any uncertainty by reason of two or more persons having received an equal number of votes being decided in favour of the licensed pilot or pilots having the longest service) and such members shall thereupon be the Pilot- members. This list shall be posted up in the Head Office of the Authority and in the Pilot Shore Station.", and

( c ) the insertion after paragraph 4 of the Schedule thereto of the following paragraph:—

"5. The persons who are members of the Committee immediately before the commencement of the Dublin Pilotage Order, 1925 (Amendment) Order, 1982, shall continue in office until their successors are appointed or elected in the month of February, 1982.".

EXPLANATORY NOTE.

This Order alters the constitution of the Pilotage Committee of the Dublin Pilotage Authority by increasing from two to three the number of pilot members.
