TRANSIT OF ANIMALS ORDER, 1982.

I, BRIAN LENIHAN, Minister for Agriculture, in exercise of the powers conferred on me by sections 3 , 6 and 29 of the Diseases of Animals Act, 1966 (No. 6 of 1966), as adapted by the Agriculture and Fisheries (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 31 of 1977 ), hereby order as follows:—

1. (1) This Order may be cited as the Transit of Animals Order, 1982.

(2) The Transit of Animals Orders, 1927 to 1973, and this Order may be cited together as the Transit of Animals Orders, 1927 to 1982.

(3) This Order shall come into operation on the 3rd day of May, 1982.

2. (1) Animals to which this Article applies shall, prior to being exported across the land frontier to any place other than a place in Northern Ireland, be inspected by an inspector and if the inspector is satisfied that the animals are fit for transportation, he shall issue a certificate to that effect.

(2) In this Article "animals to which this Article applies" means horses, cattle, sheep, goats, all other ruminating animals and swine.

3. (1) There shall be paid to the Minister, in such manner as he shall direct, in respect of the issue of a certificate under either Article 12 of the Transit of Animals (General) Order, 1973 ( S.I. No. 292 of 1973 ), or Article 2 of this Order, other than a certificate which is so issued in respect of an animal being exported to Northern Ireland, a fee calculated in accordance with paragraph (2) of this Article, and the fee payable under this Article shall be paid by the owner or the person who is for the time being in charge of the animals to which the certificate relates.

(2) A fee payable under this Article shall be calculated by reference to the number of animals to which it relates and in accordance with such of the following rates as is or are appropriate:

( a ) in case the relevant certificate relates to cattle, a rate of £1.75 per head of such cattle,

( b ) in case such certificate relates to horses, a rate of £1.75 per such horse,

( c ) in case such certificate relates to sheep, a rate of £0.30 per such sheep,

      and

( d ) in case such certificate relates to pigs, a rate of £0.50 per such pig.

EXPLANATORY NOTE.

This Order specifies the fees payable for certificates issued in respect of the veterinary inspection of livestock prior to exportation to places other than Northern Ireland. Such inspections are being extended to include livestock exported via Northern Ireland to other destinations.
