CIVIL SERVICE WIDOWS' AND CHILDREN'S CONTRIBUTORY PENSION (AMENDMENT) SCHEME, 1981.

I, GENE FITZGERALD, Minister for the Public Service, in exercise of the powers conferred on me by section 2 of the Superannuation and Pensions Act, 1976 (No. 22 of 1976), hereby make the following scheme:

1. (1) This Scheme may be cited as the Civil Service Widows' and Children's Contributory Pension (Amendment) Scheme, 1981.

(2) The Civil Service Widows' and Children's Contributory Pension Schemes, 1977 and 1979, and this Scheme may be cited together as the Civil Service Widows' and Children's Contributory Pension Schemes, 1977 to 1981.

2. This Scheme shall be deemed to have come into force on the 1st day of March, 1980.

3. In this Scheme the "Principal Scheme" means the Civil Service Widows' and Children's Contributory Pension Scheme, 1977 ( S.I. No. 132 of 1977 ).

4. The Principal Scheme is hereby amended by—.

( a ) the addition of the following paragraph to Article 3:

"(6) In this Scheme, except in Article 4(IA), every word importing the feminine gender shall be construed as if it also imported the masculine gender.".

( b ) the insertion of the following paragraph in Article 4 after paragraph (1):

"(IA) Any female civil servant, other than one to whom section 28 (2) of the Finance (Miscellaneous Provisions) Act, 1968 , applies who,

( a ) (i) becomes an established civil servant on or after the 1st of June, 1981, or

(ii) being an established civil servant during the whole or any part of the period beginning on the 1st day of March, 1980, and ending on the 31st day of May, 1981, during the said period either elects to join this Scheme or does not exercise an option,

( b ) in case she is entitled to adopt the provisions of the Superannuation Act, 1954 (No. 14 of 1954), has adopted those provisions,

is a member of this Scheme.".

5. For the avoidance of doubt it is hereby declared that section 11 (b) of the Interpretation Act, 1937 (No. 38 of 1937), neither applies nor has effect in relation to Article 4(1) of the Principal Scheme.

EXPLANATORY NOTE.

This scheme amends the Civil Service Widows' and Children's Contributory Pension Scheme, 1977 ( S.I. No. 132 of 1977 ) to enable the admission of female civil servants to it on terms similar to those already applicable to male civil servants.
