SUPERANNUATION (FEMALE CIVIL SERVANTS) REGULATIONS, 1981.

I, GENE FITZGERALD, Minister for the Public Service, in exercise of the powers conferred on me by section 2 of the Superannuation Act, 1954 (No. 14 of 1954), and the Public Service (Transfer of Departmental Administration and Ministerial Functions) Order, 1973 ( S.I. No. 294 of 1973 ), hereby make the following regulations:

1. (1) These Regulations may be cited as the Superannuation (Female Civil Servants) Regulations, 1981.

(2) The Principal Regulations and these Regulations may be cited together as the Superannuation (Female Civil Servants) Regulations, 1954 and 1981.

2. In these Regulations "the Principal Regulations" means the Superannuation (Female Civil Servants) Regulations, 1954 ( S.I. No. 76 of 1954 ).

3. (1) Notwithstanding the requirement of Regulation 4(2) of the Principal Regulations as to the lodgement of a notification under those Regulations, any female person who is a person to whom those Regulations apply and who during the whole of the period beginning on the 13th day of April, 1954, and ending on the 1st day of March, 1980, was an established civil servant may notify the Minister for the Public Service that she wishes, subject to the provisions of those Regulations as amended by these Regulations, to adopt the provisions of the Superannuation Act, 1954 (No. 14 of 1954).

(2) An adoption, by virtue of this Regulation, of the provisions of the Superannuation Act, 1954 , shall have effect as from the date on which the application is lodged, or, where the applicant ceased to be an established civil servant before the lodgement of the application, as from the date of such cesser.

(3) Regulation 4(2) of the Principal Regulations shall, in relation to a notification made by virtue of these Regulations, be construed and have effect as if there were omitted from the form prescribed by that Regulation (and contained in the Schedule to the Principal Regulations) the question set out at item number 4 on that form.

4. (1) Paragraphs (2), (3) and (4) of Regulation 4 of the Principal Regulations shall apply in relation to notifications which may be or are given by virtue of Regulation 3 of these Regulations but in applying those paragraphs to any such notification the references therein to the 13th day of October, 1954, shall each be construed as being a reference to the 31st day of May, 1981.

(2) Regulation 5 of the Principal Regulations shall not apply as regards any adoption, by virtue of Regulation 3 of these Regulations, of the provisions of the Superannuation Act, 1954 .

EXPLANATORY NOTE.

These Regulations amend the Superannuation (Female Civil Servants) Regulations, 1954 ( S.I. No. 76 of 1954 ) in order to enable certain female civil servants to adopt the provisions of the Superannuation Act 1954 .
