S.I. No. 425/1981 - Safety in Industry (General Register) Regulations, 1981.


I, LIAM KAVANAGH, Minister for Labour, in exercise of the powers conferred on me by section 122 of the Factories Act, 1955 (No. 10 of 1955), and the Labour (Transfer of Departmental Administration and Ministerial Functions) Order, 1966 ( S.I. No. 164 of 1966 ), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Safety in Industry (General Register) Regulations, 1981.

(2) The Factories (General Register) Regulations, 1956 ( S.I. No. 177 of 1956 ), and these Regulations may be cited together as the Safety in Industry (General Register) Regulations, 1956 and 1981.

(3) These Regulations shall come into operation on the 1st day of March, 1982.

2. The particulars of every test and examination carried out in compliance with the requirements of section 22 (4) of the Safety in Industry Act, 1980 (No. 9 of 1980), and required by that section to be entered in the general register, shall be the following:

(a) a distinguishing number or description sufficient to identify the relevant warning system,

(b) the date on which the test or examination was carried out and the name of the person by whom it was carried out, and

(c) particulars of any defect found on such examination or test and the date on which anything was done to remedy such defect together with particulars of the thing so done.

3. The particulars of every fire drill required by section 48 (4) of the Factories Act, 1955 (No. 10 of 1955) (inserted by section 23 of the Safety in Industry Act, 1980 ) to be attached to the general register, shall be the following:

(a) the time and date on which the drill was held and by whom it was supervised,

(b) the time taken to evacuate the premises concerned,

(c) what, if any, firefighting or escape equipment was handled, used or operated,

(d) if there was an evacuation, a description thereof, and

(e) particulars of any notice given by Minister under section 48 (3) of the Factories Act, 1955 (inserted by section 23 of the Safety in Industry Act, 1980 ).

4. The following Schedule is hereby substituted for the Schedule to the Factories (General Register) Regulations, 1956:

“SCHEDULE

GENERAL REGISTER

Name of Occupier.

(in the case of a firm which is not a registered company, the name of each partner should be entered).

Address of Factory.

(Include name of Sanitary Authority for district in which factory is situated).

Nature of work carried on.

Reports and Certificates required to be attached to the General Register.

Nature of Certificate, Date of Certificate.

Names of persons (if any) appointed as machinery attendants for the purposes of the Safety in Industry (Operations at Unfenced Machinery) Regulations, 1956 and 1981.

Date of appointment.

Safety Committee, Safety Delegate and Safety Representative.

Date of establishment of Safety Committee (if any).

Name of Safety Delegate (if any).

Name of Safety Representative (if any).

Date of revocation (if any) of appointment of Safety Delegate.

Date of revocation (if any) of appointment of Safety Representative.

OUTWORKERS

The occupier is required to keep (in Form F.I. 1016) a list of outworkers employed in certain specified classes of work. A copy of the list must be sent to the Sanitary Authority during the month of February and the month of August each year.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations prescribe the particulars of every test and examination on means of giving warning in case of fire to be entered in the General Register and the particulars of every fire drill carried out to be attached to the General Register.
