S.I. No. 300/1981 - Finance Act, 1981 (Certificates of Reasonable Cost) Regulations, 1981.


The Minister for the Environment in exercise of the powers conferred on him by section 5 of the Housing Act, 1966 (No. 21 of 1966) and section 18 of the Housing (Miscellaneous Provisions) Act, 1979 (No. 27 of 1979) (as applied by sections 23 and 24 of the Finance Act, 1981 (No. 16 of 1981)) hereby makes the following Regulations:—

Citation.

1. These Regulations may be cited as the Finance Act, 1981 (Certificates of Reasonable Cost) Regulations, 1981.

Interpretation.

2. In these Regulations—

“the Minister” means the Minister for the Environment;

“a certificate” means a certificate of reasonable cost;

“the Act of 1979” means the Housing (Miscellaneous Provisions) Act, 1979 ;

“the Act of 1981” means the Finance Act, 1981 .

Documents to accompany application under sections 23 or 24 of Act of 1981.

3. An application to the Minister for a certificate under section 23 or section 24 of the Act of 1981 shall be accompanied by—

(a) evidence that permission or outline permission and approval under the Local Government (Planning and Development) Acts, 1963 and 1976 has been granted in respect of the house,

(b) floor plans, elevations and sections of the house, drawn to a scale of not less than 1:50,

(c) a site plan showing the location of the house,

(d) detailed specifications of workmanship and materials to be used,

(e) details of such fixtures, fittings and other articles as are included with the house, their design, manufacture and finish, their nature and quality and the fitting or installation of such fixtures, fittings and articles,

(f) a notification of the amount claimed in respect of the cost of the construction or conversion.

Additional Information.

4. The Minister may require the person making the application in accordance with article 3 of these Regulations to supply such other information relating to the cost of the construction or conversion or any or all of the constituent elements thereof as he considers necessary for the purposes of determining the application.

Fees.

5. The fee accompanying an application for a certificate shall be as follows—

(a) in case the application relates to one house only, £25,

(b) in case the application relates to more than one house, £25 plus £6 in respect of each house exceeding one.
