S.I. No. 276/1981 - Road Traffic (Licensing of Drivers) (Amendment) (No. 2) Regulations, 1981.


The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 33 and 42 of the Road Traffic Act, 1961 (No. 24 of 1961), hereby makes the following Regulations:

1. (1) These Regulations may be cited as the Road Traffic (Licensing of Drivers) (Amendment) (No. 2) Regulations, 1981.

(2) The expression, the Road Traffic (Licensing of Drivers) Regulations, 1964 to 1981, shall include these Regulations.

(3) In these Regulations

“the Regulations of 1981” means the Road Traffic (Licensing of Drivers) (Amendment) Regulations, 1981 ( S.I. No. 198 of 1981 ).

2. Article 29 of the Road Traffic (Licensing of Drivers) Regulations, 1964 ( S.I. No. 29 of 1964 ) as amended by article 9 of the Regulations of 1981 is hereby further amended by the substitution therein for clause (iv) of paragraph (a) of sub-article (1) of the following clause—

“(iv) the application relates to vehicles of Class H, and

(A) the applicant held a licence to drive vehicles of Class D at any time during the period of five years ending on the 30th day of June, 1981, or the applicant held a certificate of competency to drive vehicles of Class D on the 30th day of June, 1981, and, in either case, the application is accompanied by a certificate in the form set out in Part II of the Third Schedule to these Regulations to the effect that the applicant had, during the period of five years preceding the date of his application, driven articulated vehicles on not less than 65 days; or

(B) the applicant held a licence to drive vehicles of Class D on the 30th day of June, 1981, and the application is accompanied by a statement by the applicant's employer or, where he was self-employed, by the applicant, that on the 30th day of June, 1981, the applicant's employment or occupation was such as to require him to drive articulated vehicles and that he drove vehicles of that class in such employment or occupation.”
