LIMERICK APPOINTED STANDS (STREET SERVICE VEHICLES) BYE-LAWS, 1980.

ARRANGEMENT OF BYE-LAWS.

1. Short title.

I, PATRICK McLAUGHLIN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by section 84 (as amended by section 6 of the Road Traffic Act, 1968 (No. 25 of 1968)) of the Road Traffic Act, 1961 (No. 24 of 1961), with the consent of the Minister for the Environment and after consultation with the Mayor, Aldermen and Burgesses of Limerick, hereby make the following bye-laws in respect of the area comprising the county borough of Limerick:

1 Short title

1. These bye-laws may be cited as the Limerick Appointed Stands (Street Service Vehicles) Bye-Laws, 1980.

2 Interpretation.

2. (1) In these bye-laws "street" means a public road.

(2) In these bye-laws reference to the head of an appointed stand shall be construed as referring to that end of the appointed stand from which the limits of the appointed stand are reckoned in column (3) of the First Schedule to these bye-laws, and reference to the rear of an appointed stand shall be construed as referring to that end of the appointed stand to which the limits of the appointed stand are so reckoned.

3 Appointment of appointed stands.

3. In each street mentioned in column (2) of the First Schedule to these bye-laws, the part of that street described in column (3) of that Schedule opposite the mention in column (2) of that street shall be an appointed stand and, subject to these bye-laws, shall be available for use without limitation as to time or occasion.

4 Main and subsidiary appointed stands.

4. For the purpose of these bye-laws—

( a ) each of the appointed stands mentioned in column (2) of the Second Schedule to these bye-laws shall be known as a main appointed stand;

( b ) each of the appointed stands mentioned in column (3) of that Schedule shall be known as a subsidiary appointed stand.

5 Position of vehicles on appointed stands.

5. (1) The following provisions apply to a street service vehicle standing for hire at an appointed stand:

( a ) the vehicle shall be placed in the appropriate position specified in column (5) of the First Schedule to these bye-laws;

( b ) the whole of the vehicle shall be inside the limits of the stand specified in column (3) of that Schedule;

( c ) the distance from the kerb to the nearest part of the vehicle shall not exceed 18 inches;

( d ) where there is no street service vehicle already on the stand the vehicle shall be placed at the head of the stand, and each vehicle subsequently entering the stand shall, subject to bye-law 6 of these bye-laws, be placed as close as practicable to the vehicle at the head of the stand.

(2) A street service vehicle placed at an appointed stand but not complying with paragraph (1) of this bye-law shall be deemed for the purpose of these bye-laws not to be standing for hire on that stand.

6 Maximum number of street service vehicles at appointed stands

6. Whenever the number of street service vehicles standing for hire on an appointed stand is equal to the number mentioned in column (4) of the First Schedule to these bye-laws opposite the mention of the appointed stand in column (3) of that Schedule, the driver of a street service vehicle not already so standing for hire shall not place that vehicle on that stand.

7 Vacancies at appointed stands

7. (1) Whenever a vacancy occurs at an appointed stand by reason of the departure from the stand of a street service vehicle, the street service vehicle nearest to the space so vacated shall be moved forward by its driver into that space and each driver of any other street service vehicle then standing on that appointed stand shall in turn move forward his vehicle into the space which is nearest to him and in the direction of the head of the appointed stand.

(2) Whenever a vacancy occurs on a main appointed stand by reason of the departure from the stand of a street service vehicle, the driver of the street service vehicle at the head of the subsidiary appointed stand first referred to in column (3) of the Second Schedule to these bye-laws opposite the mention in column (2) of that Schedule of the main appointed stand (or, where two subsidiary appointed stands are so referred to, the driver of the street service vehicle at the head of the first subsidiary appointed stand so referred to), shall place that street service vehicle on the main appointed stand in the space created by the vacancy.

(3) Whenever a vacancy occurs on a subsidiary appointed stand by reason of the departure from the stand of a street service vehicle, the driver of the street service vehicle at the head of a subsidiary appointed stand referred to secondly in column (3) of the Second Schedule to these bye-laws opposite the mention in column (2) of that Schedule of the main appointed stand shall place that street service vehicle on the subsidiary appointed stand first referred to in column (3) of that Schedule opposite the mention in column (2) of that Schedule of the main appointed stand.

8 General provisions relating to appointed stands

8. (1) The following provisions apply in respect of street service vehicles standing for hire on an appointed stand:

( a ) a street service vehicle shall not be so placed on an appointed stand that it rests wholly or partly on a footway, or that portion of the vehicle projects over the footway so as to interfere with pedestrians using the footway;

( b ) a person shall not wash, overhaul or execute repairs to such a street service vehicle, except such repairs as are necessary to enable the vehicle to be removed from an appointed stand;

( c ) neither the driver of such a street service vehicle nor any other person shall make any unnecessary noise by means of or in relation to the vehicle or the engine or any equipment, fittings or instruments fitted to or carried on the vehicle or any loudspeaker in or on or in any way connected with the vehicle.

(2) The driver of a street service vehicle which is placed on, being brought into or removed from an appointed stand shall comply with all directions given to him by a member of the Garda Síochána in relation to the placing of the vehicle on the appointed stand or the bringing of the vehicle into, or the removal of the vehicle from, the appointed stand.

9 General restriction on street service vehicles standing for hire.

9. A driver of a street service vehicle shall not stand it for hire in the area comprising the county borough of Limerick otherwise than on an appointed stand and in accordance with these bye-laws.

10 Revocation.

10. The Limerick Appointed Standings (Street Service Vehicles) Bye-Laws, 1939 (S.R. and O., No. 165 of 1939), are hereby revoked.

EXPLANATORY NOTE.

These bye-laws:

(1) Provide stands for street service vehicles as indicated in the First Schedule to these bye-laws;

(2) Outline the conditions subject to which street service vehicles may lawfully use the stands;

(3) Prohibit the driver of a street service vehicle from standing the vehicle for hire elsewhere than on an appointed stand in the county borough of Limerick.
