SHANNON AIRPORT (SMALL PUBLIC SERVICE VEHICLES) BYE-LAWS 1980.

I, Albert Reynolds, Minister for Transport, in exercise of the powers conferred on me by section 16 of the Air Navigation and Transport Act, 1950 (No. 4 of 1950), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), hereby make the following Bye-laws:—

1. These Bye-laws may be cited as the Shannon Airport (Small Public Service Vehicles) Bye-laws, 1980, and shall come into operation on the 1st day of April, 1980.

2. In these Bye-laws—

"the airport" means the State aerodrome known as Shannon Airport;

"the Minister" means the Minister for Transport;

"small public service vehicle" has the meaning assigned to it by the Road Traffic Act, 1961 (No. 24 of 1961).

3. (1) For the purpose of ensuring the proper management, operation and supervision of the airport the Minister may issue a permit in respect of a small public service vehicle authorising the owner of the vehicle to carry on the business of providing a hackney service at the airport with that vehicle.

(2) A person shall not carry on the business of providing a hackney service from the airport unless he is the holder of a permit under these Bye-laws.

4. An application for a permit under these Bye-laws shall be in writing and shall be delivered to the office of the Minister at the airport or sent by post to that office.

5. An applicant for a permit under these Bye-laws shall furnish the Minister with any information requested by the Minister and relating to any matter referred to in bye-law 6 of these Bye-laws or reasonably required by the Minister to enable him to decide whether or not to issue such a permit.

6. In deciding whether or not to issue a permit under these Bye-laws the Minister shall take into account the following matters—

( a ) whether or not the applicant has, within the period of 10 years before the date of his application, been convicted of an offence under the Road Traffic Acts, 1961 to 1978, relating to a small public service vehicle,

( b ) the degree of comfort and safety which the vehicle with which the applicant proposes to carry on business at the airport is likely to afford to passengers, and

( c ) the probability of the applicant's being in a position, if required by the Minister, to assist in providing a 24 -hour service at the airport in such manner as the Minister directs.

7. Where the Minister, having complied with bye-law 6 of these Bye-laws, is satisfied that an applicant for a permit under these Bye-laws is likely to provide a satisfactory hackney service at the airport and that the number of vehicles then providing such a service there is not adequate, he shall issue a permit under these Bye-laws to him.

8. A permit under these Bye-laws shall be valid for such period, not being less than a year, as is specified in the permit and may be made subject to any conditions so specified.

9. Where the Minister is satisfied that the holder of a permit under these Bye-laws is no longer providing a satisfactory hackney service at the airport, or has contravened a condition specified in the permit, he may revoke the permit or may refuse to issue a new permit to the holder at the expiration of the period of validity of the permit specified in the permit.
