MEMBERS OF THE OIREACHTAS AND MINISTERIAL AND PARLIAMENTARY OFFICES (ALLOWANCES AND SALARIES) ORDER, 1980.

The Government, in exercise of the powers conferred on them by section 3A of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938) (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 4 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977), and section 8A of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938) (inserted by section 11 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 7 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 , hereby make the following Order:

1. This Order may be cited as the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1980.

2. In this Order—

"the Act of 1938" means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

"the Act of 1973" means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973);

"the Act of 1977" means the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977).

3. (1) The allowance payable monthly under section 3 of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), as amended by section 4 of the Act of 1973, to each member of Dáil Éireann shall, with effect from the 26th day of June, 1979, be and be deemed to have been £9,590 per annum and the allowance so payable under the said section 3, as so amended, to each member of Seanad Éireann shall, with effect from the said 26th day of June, be and be deemed to have been £5,410 per annum.

(2) Each sum specified in paragraph (1) of this Article shall, with effect from the 1st day of March, 1980, be increased by—

( a ) an amount equal to 7 per cent of that sum, and

( b ) £125.28.

4. (1) The annual sum payable by way of salary under subsection (1) of section 3 of the Act of 1938 (inserted by section 7 of the Act of 1973) or subsection (2) of the said section 3 (inserted by section 6 of the Act of 1977) shall, with effect from the 26th day of June, 1979, be and be deemed to have been a sum not exceeding—

( a ) in the case of the Taoiseach, £16,930,

( b ) in the case of the Tánaiste, £12,470,

( c ) in the case of a member of the Government, other than the Taoiseach or the Tánaiste, £11,230, and

( d ) in the case of a Minister of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977), £6,710.

(2) Each sum specified in paragraph (1) of this Article shall, with effect from the 1st day of March, 1980, be increased by an amount equal to 7 per cent. of that sum.

5. (1) The annual sum payable by way of salary under section 4 of the Act of 1938 (inserted by section 8 of the Act of 1973) to the Attorney General with effect from the 26th day of June, 1979, shall be and be deemed to have been a sum not exceeding—

( a ) in case the person who holds the office is not a member of either House of the Oireachtas, £17,600,

( b ) in case a member of either House of the Oireachtas holds the office, £11,230.

(2) The sum specified in subparagraph (a) of paragraph (1) of this Article shall, with effect from the 1st day of March, 1980, be increased by—

( a ) an amount equal to 7 per cent. of that sum, and

( b ) £125.28, and

the sum specified in paragraph (b) of the said paragraph (1) shall, with effect from the said 1st day of March, be increased by an amount equal to 7 per cent. of that sum.

6. (1) ( a ) The annual sum payable by way of salary under section 5 (1) of the Act of 1938 (inserted by section 9 of the Act of 1973) to the Chairman of Dáil Éireann shall, with effect from the 26th day of June, 1979, be and be deemed to have been a sum not exceeding £11,230, and the annual sum so payable under the said section 5 (1) to the Deputy Chairman of Dáil Éireann shall, with effect from the said 26th day of June, be and be deemed to have been a sum not exceeding £5,150, and

( b ) the annual sum payable by way of salary under section 6 (1) of the Act of 1938 (inserted by section 10 of the Act of 1973) to the Chairman of Seanad Éireann shall, with effect from the 26th day of June, 1979, be and be deemed to have been a sum not exceeding £4,870, and the annual sum so payable under the said section 6 (1) to the Deputy Chairman of Seanad Éireann shall, with effect from the said 26th day of June, be and be deemed to have been a sum not exceeding £2,720.

(2) Each sum specified in paragraph (1) of this Article shall, with effect from the 1st day of March, 1980, be increased by an amount equal to 7 per cent. of that sum.

7. The increases provided for in the preceding provisions of this Order and expressed to take effect from the 1st day of March, 1980, are calculated in accordance with the provisions of Clause 2.1. (excluding the second subparagraph) of Appendix 1 of the National Understanding for Economic and Social Development dated July, 1979 except that such of these increases as are effected by Articles 4 (2), 5 (2) and 6 (2) of this Order in the case of—

( a ) the Taoiseach,

( b ) the Tánaiste,

( c ) members of the Government other than the Taoiseach or the Tánaiste,

( d ) Ministers of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977),

( e ) an Attorney General who is a member of either House of the Oireachtas,

( f ) the Chairman of Dáil Éireann,

( g ) the Deputy Chairman of Dáil Éireann,

( h ) the Chairman of Seanad Éireann, and

( i ) the Deputy Chairman of Seanad Éireann,

do not include the increase provided for in the said clause 2.1 in respect of increases above 12 per cent. in the Consumer Price Index in the period from mid-November, 1978, to mid-November, 1979.

8. The annual sum payable under section 9A of the Act of 1938 (inserted by section 13 of the Act of 1973) or section 10 of the Act of 1938, as amended by section 14 of the Act of 1973, by way of allowance for expenses,

( a ) shall, with effect from the 26th day of June, 1979, be and be deemed to have been,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £27,775,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £19,443,

(iii) in case any such sum is payable under paragraph (b) of subsection (2) of the said section 9A, £8,332,

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £13,888,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £13,888, divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £69,438,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £58,607,

(viii) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (2), £25,831,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £34,719, and

(x) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (3), £34,719, divided in the manner specified in that paragraph,

( b ) shall, with effect from the 1st day of March, 1980, be,

(i) in case any such sum is payable under subsection (1) of the said section 9A, £30,078,

(ii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 9A, £21,055,

(iii) in case any such sum is payable under paragraph (b) of the said subsection (2), £9,023,

(iv) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 9A, £15,039,

(v) in case any such sum is payable under paragraph (b) of the said subsection (3), £15,039, divided in the manner specified in that paragraph,

(vi) in case any such sum is payable under subsection (1) of the said section 10, £75,194,

(vii) in case any such sum is payable under paragraph (a) of subsection (2) of the said section 10, £62,636,

(viii) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (2), £27,558,

(ix) in case any such sum is payable under paragraph (a) of subsection (3) of the said section 10, £37,597,

(x) in case any such sum is payable under paragraph (b) of the last-mentioned subsection (3), £37,597, divided in the manner specified in that paragraph.

EXPLANATORY NOTE.

This Order gives to members of the Oireachtas and Office Holders the first phase of the increases recommended in Report No. 20 of the Review Body on Higher Remuneration in the Public Sector and increases the sums payable to leaders of qualified Parties in Dáil Éireann. It also applies the second phase of the increases provided for in the National Understanding for Economic and Social Development.
