SOCIAL WELFARE (MODIFICATION OF CONTRIBUTION CONDITIONS FOR BENEFIT) REGULATIONS, 1980.

The Minister for Social Welfare, in exercise of the powers conferred on him by sections 3 and 14 of the Social Welfare Act, 1952 (No. 11 of 1952), hereby makes the following Regulations:—

1. These Regulations may be cited as the Social Welfare (Modification of Contribution Conditions for Benefit) Regulations, 1980.

2. These Regulations shall come into operation on the 5th day of January, 1981.

3. The contribution conditions set out in the Fourth Schedule to the Social Welfare Act, 1952 (No. 11 of 1952) are hereby modified by the insertion, after paragraph 1A, inserted by the Social Welfare (Modification of Contribution Conditions for Benefit) Regulations, 1956 ( S.I. No. 156 of 1956 ), of the following:

"IB. Where a person has been entitled to payment of disability benefit in respect of any day which is in, or is after, the benefit year which includes the 3rd day of January 1981, or would, but for the provisions of subsection (2) of section 15 or subsection (1) of section 17 of this Act, have been so entitled, then, as respects disability benefit, the benefit year which includes the first such day in every period of incapacity for work which is, or is deemed to be, a separate period of incapacity, shall, for the purpose of the condition contained in subparagraph (b) of paragraph 1 of this Schedule, be regarded as continuing for each day of incapacity for work in that period in respect of which the person's right to such benefit has not been exhausted up to and including the 312th day in respect of which such benefit has been paid".

In accordance with section 14 (4) of the Social Welfare Act, 1952 a draft, sanctioned by the Minister for Finance, of these Regulations was laid before and approved by each House of the Oireachtas. The necessary Resolutions were passed by Dáil Éireann on 27 November, 1980 and by Seanad Éireann on 3 December, 1980.

EXPLANATORY NOTE.

These Regulations provide for a modification of the contribution conditions for disability benefit so that the rate of disability benefit initially applicable will not be affected by the intervention of a new benefit year for up to one year from the commencement of a period of incapacity.
