EUROPEAN COMMUNITIES (INTRODUCTION OF ORGANISMS HARMFUL TO PLANTS OR PLANT PRODUCTS) (PROHIBITION) (AMENDMENT) REGULATIONS, 1980.

I, RAY MacSHARRY, Minister for Agriculture, considering there is an imminent danger of the introduction or spread in the State of species of Liriomyza (being a danger described in Article 15 of Council Directive No. 77/93/EEC(1) of 21 December, 1976), in exercise of the powers conferred on me by Section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby make the following regulations:—

1. (1) These Regulations may be cited as the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) (Amendment) Regulations, 1980.

(2) The citation "the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations, 1980" shall include these Regulations.

2. In these Regulations "the Principal Regulations" means the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations, 1980 ( S.I. No. 125 of 1980 ).

3. The Principal Regulations are hereby amended by the insertion of the following regulation after Regulation 2:

"2A. (1) A person shall not introduce into the State any species of Liriomyza or any plant, plant product or other thing which is contaminated with any such species or on which any such species is otherwise present.

(2) Any person who contravenes paragraph (1) of this Regulation shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £300".

4. The Principal Regulations are hereby amended by—

( a ) the substitution of " ,9 or 11 (2)" for "or 9" in paragraph (1) of Regulation 17; and

( b ) the substitution of "11 (1) or 15" for "14" in paragraph (4) of Regulation 17,

and the said paragraphs (1) and (4), as so amended, are set out in paragraphs 1 and 2, respectively, of the Table to this Regulation.

TABLE

1. Any person who contravenes Regulation 3, 4, 5, 6, 7, 8, 9, or 11 (2) of these Regulations shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £300.

2. Any person who obstructs or interferes with an authorised person in the course of exercising a power conferred on him under Regulation 11 (1) or 15 of these Regulations shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £100.

EXPLANATORY NOTE.

The Regulations prohibit the introduction into the country of Liriomyza species (leaf miner pests), and amend some provisions of the original Regulations relating to penalties for offences.
