PUBLIC RECORDS (FEES) ORDER, 1980.

I, GERARD COLLINS, Minister for Justice in exercise of the powers conferred on me by section 17 of the Public Records (Ireland) Act, 1867, and section 11 of the Adaption of Enactments Act, 1922 (No. 2 of 1922), and with the approval of the Minister for Finance, hereby order as follows:

1. (1) This Order may be cited as the Public Records (Fees) Order, 1980.

(2) This Order shall come into operation on the 1st day of October, 1980.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to this Order.

3. The fees specified in the second column of the Schedule to this Order shall be charged in the Public Record Office in respect of the items specified in the first column of the Schedule to this Order.

4. Where copies of records are sent by the Public Record Office by prepaid post to persons requesting them—

( a ) a fee equal to the cost of such posting may be charged in the said Office in respect of the copies in addition to any fees which may be charged under Article 3 of this Order, and

( b ) if the request for the copies was sent to the said Office by prepaid post and the fees chargeable in the said Office under this Order would, apart from this paragraph, be less than £1.00 in total, a single fee of £1.00 shall be charged in the said Office in respect of such copies in lieu of the said fees.

5. (1) When applications are made for copies, inspections or attendances with a record by any public department or office, the fees on which, if paid, would be a charge on public funds, the fees provided for by this Order shall not be charged.

(2) The Deputy Keeper of Public Records may, at his discretion, permit inspections solely for the purposes of research to be made without charge.

6. The Public Records (Fees) Order, 1955 ( S.I. No. 53 of 1955 ), is hereby revoked.

(e) Where records are deemed to be unsuitable for reproduction by available reprographic processes, the Deputy Keeper may issue a manuscript or typed copy and in such cases fees calculated at the rate of £3.00 per hour or portion of an hour will be charged.

(f) Where colouring of copies of maps, plans, drawings or similar records is required, an additional fee calculated at the rate of £3.00 per hour or portion of an hour will be charged.

RULES FOR DISPENSING IN CERTAIN CASES WITH THE PAYMENT OF FEES

(a) When applications are made for copies, inspections or attendances with a record by any public department or office, the fees on which if paid, would be a charge on public funds, the foregoing fees are not to be charged.

(b) The Deputy Keeper of Public Records may, at his discretion, permit inspections solely for the purposes of research to be made without charge.

EXPLANATORY NOTE.

The purpose of this Order is to prescribe the fees chargeable in the Public Record Office as from the 1st October, 1980. The present fees are prescribed in the Public Records (Fees) Order, 1955, which is revoked by this Order.
