WIRELESS TELEGRAPHY (BUSINESS RADIO LICENCE (AMENDMENT) REGULATIONS, 1980.

I, MARK KILLILEA, Minister of State at the Department of Posts and Telegraphs, in exercise of the powers conferred on me by section 6 (1) of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), and the Posts and Telegraphs (Delegation of Ministerial Functions) Order, 1980 (S.I. No. 20 of 1980), and with the consent of the Minister for Finance, hereby make the following regulations:

1. (1) These Regulations may be cited as the Wireless Telegraphy (Business Radio Licence) (Amendment) Regulations, 1980.

(2) The Regulations of 1949, the Regulations of 1956, the Regulations of 1957 and these Regulations may be cited together as the Wireless Telegraphy (Business Radio Licence) Regulations, 1949 to 1980.

(3) These Regulations shall come into effect on the 1st day of July, 1980.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations:

"the Regulations of 1949" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1949 ( S.I. No. 320 of 1949 );

"the Regulations of 1956" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1956 ( S.I. No. 2 of 1956 );

"the Regulations of 1957" means the Wireless Telegraphy (Business Radio Licence) Regulations, 1957 ( S.I. No. 181 of 1957 ).

4. Paragraph (1) of Regulation 9 of the Regulations of 1949 (inserted by Regulation 4 of the Regulations of 1956) is hereby amended by—

( a ) the substitution of "seven pounds" for "five pounds" in both places where it occurs in subparagraph (a);

( b ) the substitution of "seven pounds", "seven pounds" and "twenty-five pounds" for "five pounds", "five pounds" and "twenty pounds", respectively, in subparagraph (b);

( c ) the substitution of "thirty-two pounds" and "seven pounds" for "twenty-five pounds" and "five pounds", respectively, in subparagraph (c);

( d ) the substitution of "thirty-two pounds", "seven pounds" and "twenty-five pounds" for "twenty-five pounds", "five pounds" and "twenty pounds", respectively, in subparagraph (d);

and the said paragraph (1), as so amended, is set out in the Table to this Regulation.

TABLE.

(1) A fee shall be payable on the issue and on each renewal of a business radio licence and such fee shall be calculated on the following basis:—

( a ) system comprising base and mobile stations only or system comprising mobile stations only: a fixed sum of seven pounds plus seven pounds for each station,

( b ) system comprising base, repeater and mobile stations or mobile and repeater stations: a fixed sum of seven pounds plus seven pounds for each base station and each mobile station plus twenty-five pounds in respect of each repeater station,

( c ) system comprising two fixed stations only, that is to say, a fixed point-to-point system: a fixed sum of thirty-two pounds plus seven pounds for each station,

( d ) system comprising two fixed stations with repeater stations, that is to say, a fixed point-to-point system with repeater stations: a fixed sum of thirty-two pounds plus seven pounds for each fixed station plus twenty-five pounds in respect of each repeater station.

5. Regulation 7 of the Regulations of 1957 is hereby amended by—

( a ) the substitution of "four pounds" for "three pounds" in both places where it occurs in paragraph (a);

( b ) the substitution of "four pounds" for "three pounds" in both places where it occurs and of "fifteen pounds" for "twelve pounds" in paragraph (b);

( c ) the substitution of "nineteen pounds" and "four pounds" for "fifteen pounds" and "three pounds", respectively, in paragraph (c); and

( d ) the substitution of "nineteen pounds", "four pounds" and "fifteen pounds" for "fifteen pounds", "three pounds" and "twelve pounds", respectively, in paragraph (d);

and the said Regulation 7, and so amended, is set out in the Table to this Regulation.

7. A fee shall be payable on the issue and renewal of a licence and such fee shall be calculated on the following basis:

( a ) system comprising base and mobile stations only or system comprising mobile stations only: a fixed sum of four pounds plus four pounds for each station,

( b ) system comprising base, repeater and mobile stations or mobile and repeater stations: a fixed sum of four pounds plus four pounds for each base station and each mobile station plus fifteen pounds in respect of each repeater station,

( c ) system comprising two fixed stations only, that is to say, a fixed point-to-point system: a fixed sum of nineteen pounds plus four pounds for each station,

( d ) system comprising two fixed stations with repeater stations, that is to say, a fixed point-to-point system with repeater stations: a fixed sum of nineteen pounds plus four pounds for each fixed station plus fifteen pounds in respect of each repeater station.

EXPLANATORY NOTE.

The purpose of these Regulations is to provide for an increase in the fees payable under the Wireless Telegraphy (Business Radio Licence) Regulations, 1949 to 1957 as follows:

"Annual" Business Radio Licences

( a ) System comprising base and mobile stations only;

(i) Fixed Sum

from £5 to £7

(ii) For each Station

from £5 to £7

( b ) System comprising base, repeater and mobile stations or mobiles and repeater stations;

(i) Fixed Sum

from £5 to £7

(ii) For each base and mobile station

from £5 to £7

(iii) For each repeater station

from £20 to £25

( c ) System comprising two fixed stations only;

(i) Fixed Sum

from £25 to £32

(ii) For each station
