ROAD TRANSPORT ACT, 1978 (SECTION 5) ORDER, 1980.

I, ALBERT REYNOLDS, Minister for Transport, in exercise of the powers conferred on me by section 5 of the Road Transport Act, 1978 (No. 8 of 1978), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), hereby order as follows:

1. This Order may be cited as the Road Transport Act, 1978 (Section 5) Order, 1980.

2. The classes of international transport by road which are specified in paragraphs (1) (d) to (1) (j) of Article 5 of the agreement made on the 9th day of April, 1980, between the Government and the Government of the United Kingdom on the international carriage of goods by road (being an international agreement relating to international transport by road), and which are set out in the Schedule to this Order, are hereby exempted from the provisions of sections 9 and 34 of the Road Transport Act, 1933 (as amended or extended) and section 7 of the Road Transport Act, 1935 (as amended or extended).

SCHEDULE.

Classes of International Transport by Road Referred to in paragraph 2.

( d ) Transport on own-account, provided that an appropriate own-account document is carried on the vehicle, the form of the document to be agreed by the competent authorities of the State and the United Kingdom.

( e ) Transport of spare parts and provisions for ocean-going ships.

( f ) Transport of works and objects of art for fairs and exhibitions or for commercial purposes.

( g ) Transport of articles and equipment intended exclusively for advertising and information purposes.

( h ) Unladen runs by goods vehicles, provided that if the vehicle is entering to collect goods, the permit applying to the transport operation which is to follow is carried on the vehicle on entry.

( j ) Transport of properties, accessories and animals to or from theatrical, musical, film, sports or circus performances, fairs or fetes and those intended for radio, recordings, or for film, or television productions.

EXPLANATORY NOTE.

The effect of this Order is that a merchandise licence, a vehicle plate, a licence under Section 7 of the Road Transport Act, 1935 , or a restricted road freight licence under the Road Transport Acts are not required in respect of the classes of international transport by road specified in paragraphs (1) (d) to (1) (j) of Article 5 of the Road Transport Agreement between the Government and the Government of the United Kingdom dated 9th April, 1980, and set out in the Schedule to this Order.
