OIL POLLUTION OF THE SEA (RECORDS) REGULATIONS, 1980.

I, ALBERT REYNOLDS, Minister for Transport, in exercise of the powers conferred on me by sections 17 (1) and 17 (3) of the Oil Pollution of the Sea Act, 1956 (No. 25 of 1956) (as amended by section 13 of the Oil Pollution of the Sea (Amendment) Act, 1977 (No. 15 of 1977)), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), hereby make the following Regulations:—

1. These Regulations may be cited as the Oil Pollution of the Sea (Records) Regulations, 1980, and shall come into operation on the 1st day of May, 1980.

2. (1) In these Regulations—

"the Act" means the Oil Pollution of the Sea Act, 1956 (No. 25 of 1956), as amended by the Oil Pollution of the Sea (Amendment) Act, 1977 (No. 15 of 1977);

"tanker" means a vessel the greater part of the cargo space of which is constructed or adapted for the carriage of liquid cargoes in bulk and which is either carrying a cargo of oil in bulk in that part of its cargo space or has on board oil residues from a cargo of oil in bulk previously carried;

"tons" means tons gross tonnage.

3. (1) The master of every tanker registered in the State shall carry on board ship an oil record book and shall record in it the following matters—

( a ) any of the following operations carried out on board or in connection with the ship—

(i) loading of oil cargo;

(ii) transfer of oil cargo during a voyage;

(iii) discharge of oil cargo;

(iv) ballasting of cargo tanks;

(v) cleaning of cargo tanks;

(vi) discharge of dirty ballast:

(vii) discharge of water from slop tanks;

(viii) disposal of oil residues;

(ix) discharge overboard of oily bilge water which has accumulated in machinery spaces (including pump rooms) whilst in port;

(x) the routine discharge at sea of oily bilge water;

( b ) any occasion on which oil or a mixture containing oil is discharged from the ship for the purpose of securing the safety of any vessel, of preventing damage to any vessel or cargo or of saving life;

( c ) any occasion on which oil or a mixture containing oil is found to be escaping (or to have escaped) from the ship as a result of damage to the ship or because of leakage.

(2) Entries made under this Regulation in an oil record book shall be made in the form set out in Schedule 1 to these Regulations and shall contain the particulars referred to in that form.

(3) ( a ) The requirement to keep a record imposed by paragraph (1) of this Regulation shall not apply to any discharge which is referred to in paragraph (1) (a) (x) of this Regulation and is a discharge of oily bilge water from machinery spaces (including pump rooms) if the discharge has been entered in the engine room log book or deck log book.

( b ) Any entry relating to the discharge of oily bilge water from machinery spaces (including pump rooms) whether made in the oil record book, the engine room log book or the deck log book, shall indicate whether the discharge was made through a separator, but where the pump making the discharge starts automatically and discharges at all times through a separator it will be sufficient compliance with this clause to enter on each relevant day the entry "Automatic discharge from bilges through a separator".

4. (1) The master of every ship (other than a tanker) which is registered in the State, is of 80 tons or more and uses oil fuel, shall carry on board ship an oil record book and shall record in it the following matters—

( a ) any of the following operations carried out on board or in connection with the ship—

(i) ballasting or cleaning of bunker fuel tanks;

(ii) discharge of dirty ballast or cleaning water from bunker fuel tanks;

(iii) disposal of oil residues;

(iv) discharge overboard of oily bilge water which has accumulated in machinery spaces including pump rooms in port;

(v) the routine discharge at sea of oily bilge water;

( b ) Any occasion on which oil or a mixture containing oil is discharged from the ship for the purpose of securing the safety of any vessel, of preventing damage to any vessel or cargo or of saving life;

( c ) any occasion on which oil or a mixture containing oil is found to be escaping (or to have escaped) from the ship as a result of damage to the ship, or because of leakage.

(2) Entries made under this Regulation in an oil record book shall be made in the form set out in Schedule 2 to these Regulations and shall contain the particulars referred to in that form.

(3) ( a ) The requirement to keep a record imposed by paragraph (1) of this Regulation shall not apply to any discharge which is referred to in paragraph (1) (a) (v) of this Regulation and is a discharge of oily bilge water from machinery spaces (including pump rooms) if the discharge has been entered in the engine room log book or deck log book.

5. A record prescribed by these Regulations shall be retained in the ship to which it relates for the duration of the relevant voyage and shall be surrendered by the master of the ship to the Superintendent of the Mercantile Marine Office with the ship's Official Log Book.

6. The Oil Pollution of the Sea (Records) Regulations, 1957 ( S.I. No. 206 of 1957 ), and the Oil Pollution of the Sea (Records) (Amendment) Regulations, 1967 ( S.I. No. 124 of 1967 ), are hereby revoked.

EXPLANATORY NOTE.

These Regulations apply to certain classes of Irish registered ships and require records to be kept on the matters relating to oil specified in Section 17 (1) of the Oil Pollution of the Sea Act, 1956 as amended by Section 13 of the Oil Pollution of the Sea (Amendment) Act, 1977 . They replace the Oil Pollution of the Sea (Records) Regulations 1957 as amended by the Oil Pollution of the Sea (Records) (Amendment) Regulations, 1967.
