LOCAL SECURITY FORCE (COMPENSATION FOR PERSONAL INJURIES) SCHEME, 1943 (FIFTH AMENDMENT) SCHEME, 1979.

I, GERARD COLLINS, Minister for Justice, in exercise of the powers conferred on me by section 3 of the Continuation of Compensation Schemes Act, 1946 (No. 19 of 1946) (as amended by section 4 of the Continuation of Compensation Schemes Act, 1946 (Amendment) Act, 1949 (No. 15 of 1949) ), as adapted by the Public Service (Transfer of Departmental Administration and Ministerial Functions) Order, 1973 ( S.I. No. 294 of 1973 ), and the Public Service (Delegation of Ministerial Functions) Order, 1978 ( S.I. No. 117 of 1978 ), hereby, with the consent of the Minister of State at the Department of the Public Service, make the following Scheme:

1. This Scheme may be cited as the Local Security Force (Compensation for Personal Injuries) Scheme, 1943 (Fifth Amendment) Scheme, 1979.

2. In this Scheme " the Principal Scheme " means the Local Security Force (Compensation for Personal Injuries) Scheme, 1943 (S.R. & O., No. 135 of 1943).

3. Paragraphs (1) and (2) of Article 8 of the Principal Scheme are hereby amended by the substitution, with effect from the 5th day of April, 1976, for "£13.80" (inserted by the Local Security Force (Compensation for Personal Injuries) Scheme, 1943 (Fourth Amendment) Scheme, 1975 ( S.I. No. 327 of 1975 ) ) of "an amount equal to such weekly allowance as may be payable for the time being to a qualified person under section 8(3) (b) of the Social Welfare (Occupational Injuries) Act, 1966 (No. 16 of 1966) ".

4. Paragraph (1) (a) of Article 21 of the Principal Scheme is hereby amended by the substitution, with effect from the 5th day of April, 1976, for " £12.95 " (inserted by the Local Security Force (Compensation for Personal Injuries) Scheme, 1943 (Fourth Amendment) Scheme, 1975) of"an amount equal to such weekly rate as may be payable for the time being to a qualified person under sections 17 (2) and 18 (2) of the Social Welfare (Occupational Injuries) Act, 1966 ".

5. The weekly rate of pension payable to a widow who is in receipt of compensation under the Principal Scheme shall, with effect from the 1st day of April, 1977, be increased, in the case of a widow who has attained pensionable age within the meaning of the Social Welfare Acts, 1952 to 1979, and is living alone, by an amount equal to the amount payable for the time being to a qualified person under section 20 of the Social Welfare Act, 1977 (No. 3 of 1977).

EXPLANATORY NOTE

This Scheme provides for increases in the rates of compensation payable to persons who suffered personal injuries, and to widows of members who died as a result of injuries received, in the course of Local Security Force duty in line with the rates payable under the Social Welfare (Occupational Injuries) Act, 1966 as amended from time to time.
