INFECTIOUS DISEASES (MAINTENANCE) (No. 2) REGULATIONS, 1979.

The Minister for Health, in exercise of the powers vested in him by section 5 and subsection (5) of section 44 of the Health Act, 1947 (No. 28 of 1947), hereby makes the following Regulations:—

1. These Regulations may be cited as the Infectious Diseases (Maintenance) (No. 2) Regulations, 1979.

2. The Infectious Diseases (Maintenance) Regulations, 1979 ( S.I. No. 78 of 1979 ) are hereby revoked.

3. In these Regulations—

"the Act" means the Health Act, 1947 (No. 28 of 1947);

"outgoings" means the rent, ground rent, rates and purchase annuity payable in respect of premises and mortgage repayments relating to the purchase of premises;

"receiving in-patient services" means receiving in-patient services made available under the Health Act, 1970 (No. 1 of 1970 );

"person" means a person to whom section 44 of the Act applies by virtue of subsection (1) of that section, and

"the payment" means the payment to be made under subsection (3) of section 44 of the Act to or in respect of a person or his dependants.

4. The payment shall, with effect from the 7th day of October, 1979, be a weekly payment not exceeding:—

( a ) the sum specified in Part One of the Schedule hereto which is appropriate to the person, and

( b ) such of the increases specified in Part Two of the said Schedule as are appropriate.

PART ONE.

Class of Person

1. ( a ) For a person with a dependent spouse

( b ) For a person with a dependent spouse where such person or such spouse is receiving in-patient services

( c ) For a person with a dependent spouse where both such person and spouse are receiving in-patient services

2. ( a ) For a single person or a person who is a widow or widower

( b ) For such person where such person is receiving in-patient services

SCHEDULE.

PART TWO.

Circumstances in which the sum specified in Part One of this Schedule may be increased.

Amount of Increase

( a ) For a single person or a person who is a widow or widower or a person with a dependent spouse where such person has one or more dependants (other than such spouse) and, with the approval of the health board, a helper is employed to take care of such dependant or dependants.

£8.35 or the actual wage payable to the helper employed whichever is the lesser.

( b ) In respect of each dependant (other than a spouse) over 16.

£6.45.

( c ) In respect of each dependant under 16.

£4.55.

( d ) For a person who is owner or tenant of the premises in which he ordinarily resides or who not being the owner or tenant pays or contributes substantially towards the payment of the outgoings of the premises in which he ordinarily resides.

£4.60 or the weekly amount of the outgoings or the amount of the weekly contribution towards the outgoings whichever is the lesser.

EXPLANATORY NOTE.

The effect of these Regulations is to amend the existing Regulations governing the payment of maintenance allowances to persons being treated for certain infectious diseases—the Infectious Diseases (Maintenance) Regulations, 1979 ( S.I. No. 78 of 1979 )—to provide as from 7th October, 1979, for increases in the maximum rates of allowance payable.

The Infectious diseases for which maintenance allowances are payable are acute anterior poliomyelitis, diphtheria, dysentery, lassa fever, paratyphoid A, paratyphoid B, rabies, salmonella infection, scarlet fever, streptococcal sore throat, tuberculosis, and typhus fever.
