DANGEROUS SUBSTANCES (LICENSING FEES) REGULATIONS, 1979.

I, GENE FITZGERALD, Minister for Labour, in exercise of the powers conferred on me by sections 36 and 38 of the Dangerous Substances Act, 1972 (No. 10 of 1972), hereby make the following Regulations:

1. (1) These Regulations may be cited as the Dangerous Substances (Licensing Fees) Regulations, 1979.

(2) These Regulations shall come into operation on the 28th day of September, 1979.

2. Subject to Regulation 3 of these Regulations, the fees payable in respect of the grant, transfer or replacement of licences mentioned in the first column of the Schedule to these Regulations shall be the amount specified in the third column of the said Schedule opposite the mention of the licence and which is appropriate having regard to the entries in the second column of the said Schedule and opposite the mention of the licence and the entries in the third column of the said Schedule and so opposite.

3. Where an application is made for the amendment of a licence mentioned in the first column of the Schedule to these Regulations, the amount of the fee payable in respect of the amendment shall be—

( a ) where the storage capacity of the store to which the licence as amended relates does not exceed 25,000 litres, £3,

( b ) where the storage capacity of such store exceeds 25,000 litres, an amount equal to 50 per cent of the fee paid when the licence was granted.

Licence under the Dangerous Substances (Petroleum Bulk Stores) Regulations, 1979 ( S.I. No. 313 of 1979 ).

On the grant of the licence.

The amount of the fee for each year or part of a year for which the licence is to be valid shall be:

(a) in case the storage capacity of the store to which the licence relates does not exceed 500 litres, £3,

(b) in case such storage capacity exceeds 500 litres but does not exceed 2,500 litres, £6,

(c) in case such storage capacity exceeds 2,500 litres but does not exceed 5,000 litres, £9,

(d) in case such storage capacity exceeds 5,000 litres but does not exceed 25,000 litres, £12,

(e) in case such storage capacity exceeds 25,000 litres but does not exceed 50,000 litres, £24,

(f) in case such storage capacity exceeds 50,000 litres but does not exceed 100,000 litres, £36,

(g) in case such storage capacity exceeds 100,000 litres but does not exceed 250,000 litres, £50,

(h) in case such storage capacity exceeds 250,000 litres, £100.

On the transfer or replacement of the licence.

Licence under the Dangerous Substances (Retail and Private Petroleum Stores) Regulations, 1979 ( S.I. No. 311 of 1979 ).

On the grant of the licence.

The amount of the fee for each year or part of a year for which the licence is to be valid shall be:

(a) in case the storage capacity of the store to which the licence relates does not exceed 500 litres, £3,

(b) in case such storage capacity exceeds 500 litres but does not exceed 2,500 litres, £6,

(c) in case such storage capacity exceeds 2,500 litres but does not exceed 5,000 litres, £9,

(d) in case such storage capacity exceeds 5,000 litres but does not exceed 25,000 litres, £12,

(e) in case such storage capacity exceeds 25,000 litres but does not exceed 50,000 litres, £24,

(f) in case such storage capacity exceeds 50,000 litres but does not exceed 100,000 litres, £36,

(g) in case such storage capacity exceeds 100,000 litres but does not exceed 250,000 litres, £50,

(h) in case such storage capacity exceeds 250,000 litres, £100.

On the transfer or replacement of the licence.

EXPLANATORY NOTE.

These Regulations prescribe the fees to be paid for petroleum-spirit licences pursuant to Section 38 of the Dangerous Substances Act, 1972 (No. 10 of 1972).
