RESTRICTIVE PRACTICES (MOTOR SPIRIT) ORDER, 1979.

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 8 (2) of the Restrictive Practices Act, 1972 (No. 11 of 1972 ), hereby order as follows:

1. This Order may be cited as the Restrictive Practices (Motor Spirit) Order, 1979.

2. This Order and the Restrictive Practices (Motor Spirit and Motor Vehicle Lubricating Oil) Orders, 1961 to 1978, may be cited together as the Restrictive Practices (Motor Spirit and Motor Vehicle Lubricating Oil) Orders, 1961 to 1979, and shall be construed together as one.

3. Article 3 of the Restrictive Trade Practices (Motor Spirit) Order, 1972 ( S.I. No. 150 of 1972 ), is hereby amended by the substitution of "eight years" for "seven years" (inserted by the Restrictive Practices (Motor Spirit) Order, 1978 ( S.I. No. 153 of 1978 )) in paragraph (1), and the said paragraph (1), as so amended, is set out in the Table to this Article.

TABLE.

(1) Subject to the provisions of this Article, during the period of eight years from the commencement of this Order, a person shall not operate as a company station a motor spirit station that was not operated as a company station immediately before such commencement.

EXPLANATORY NOTE.

The effect of this Order is to extend for a period of one year the provision in the Restrictive Trade Practices (Motor Spirit) Order, 1972, as amended by the Restrictive Practices (Motor Spirit) Order, 1978, which prohibits petrol companies from operating additional retail outlets.
