S.I. No. 191/1979 - European Communities (Provisional Anti-Dumping Duty on Certain Iron and Steel Goods) (Termination) Regulations, 1979.


I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Recommendation No. 720/79/ECSC1 of the 9th day of April, 1979, and Commission Recommendation No. 787/79/ECSC2 of the 20th day of April, 1979, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Provisional Anti-Dumping Duty on Certain Iron and Steel Goods) (Termination) Regulations, 1979.

2. (1) The provisional anti-dumping duty imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Iron and Steel Goods) Regulations, 1979 ( S.I. No. 84 of 1979 ), shall not be charged, levied or paid—

( a ) on any goods of the description specified in Article 3 of those Regulations which are imported into the State and which originate in and are consigned from Spain, or

( b ) on any goods of the description specified in Article 4 of those Regulations which are imported into the State and which originate in and are consigned from Brazil.

(2) Paragraph (1) ( a ) of this Article shall be deemed to have come into operation on the 11th day of April, 1979, and paragraph (1) ( b ) of this Article shall be deemed to have come into operation on the 2nd day of April, 1979.

3. (1) The provisional anti-dumping duty imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Iron and Steel Goods) (No. 2) Regulations, 1979 ( S.I. No. 143 of 1979 ), shall not be charged, levied or paid on any goods of the description specified in Article 3 of those Regulations which are imported into the State and which originate in and are consigned from Spain.

(2) Paragraph (1) of this Article shall be deemed to have come into operation on the 25th day of April, 1979.

4. For the purpose of these Regulations, the country of origin of goods shall be determined in accordance with the rules of origin contained in Council Regulation (EEC) No. 802/683 of the 27th day of June, 1968 (as amended).

EXPLANATORY NOTE.

These Regulations provide for the termination of the provisional anti-dumping duties imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Iron and Steel Goods) Regulations, 1979, insofar as they relate to the goods specified in Article 2 (1) ( a ) above with effect from 11th day of April, 1979 and insofar as they relate to the goods specified in Article 2 (1) ( b ) above with effect from 2nd day of April, 1979. They also provide for the termination of the provisional anti-dumping duty imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Iron and Steel Goods) (No. 2) Regulations, 1979 insofar as they relate to the goods specified in Article 3 (1) above with effect from 25th day of April, 1979.
