FUELS (REGULATION AND CONTROL OF SUPPLY AND DISTRIBUTION OF MOTOR SPIRIT) ORDER, 1979.

The Minister for Industry, Commerce and Energy, in exercise of the power conferred on him by section 3 of the Fuels (Control of Supplies) Act, 1971 (No. 3 of 1971), and the Energy (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 295 of 1977 ), hereby orders as follows:

1. This Order may be cited as the Fuels (Regulation and Control of Supply and Distribution of Motor Spirit) Order, 1979.

2. In this Order—

"motor spirit" means any spirit consisting wholly or partly of hydrocarbon light oils within the meaning of section 1 of the Finance (Customs Duties) (No. 4) Act, 1931 (No. 43 of 1931);

"motor-car" means a mechanically propelled vehicle designed or adapted to carry not more than eight persons, including the driver;

"motor vehicle" includes a lorry, motor-car, motor cycle, and any other mechanically propelled vehicle not designed to run on permanent rails;

"sale" includes any contract involving the disposal of motor spirit by retail, and cognate words shall be construed accordingly.

3. Subject to paragraph 6, motor spirit sold by retail shall be delivered directly into a fuel tank forming an integral part of a motor vehicle and not otherwise.

4. Subject to paragraph 6, the only quantity of motor spirit which may be delivered on sale on a particular occasion into the fuel tank of a motor-car having a fuel tank with a capacity of not less than six gallons shall be the quantity of such spirit obtainable for £5 at the retail price then and there obtaining for that motor spirit.

5. Subject to paragraph 6, the only quantity of motor spirit which may be delivered on sale on a particular occasion into the fuel tank of a motor-car having a fuel tank with a capacity of less than six gallons shall be the quantity of such spirit obtainable for £4 at the retail price then and there obtaining for that motor spirit.

6. Notwithstanding paragraphs 3 to 5, the delivery on sale on a particular occasion of a quantity of motor spirit not exceeding one half-gallon may be made by delivery other than into a fuel tank forming an integral part of a motor vehicle.

7. (1) A person shall not sell or deliver motor spirit save in accordance with this Order.

(2) A person shall not buy or take delivery of motor spirit sold or delivered in contravention of this Order.

8. This Order does not apply to the sale or delivery of motor spirit in a quantity of at least 250 gallons for the purpose of the business of the person to whom the motor spirit is sold or delivered, provided that such motor spirit is delivered pursuant to such sale in a quantity or quantities of at least 250 gallons at a time.

EXPLANATORY NOTE.

The Order provides that, subject to certain exceptions, motor spirit sold by retail shall be delivered directly into the fuel tank of a motor vehicle and specifies the only quantities which may be sold on a particular occasion.
