EUROPEAN COMMUNITIES (PROVISIONAL ANTI-DUMPING DUTIES) (MISCELLANEOUS SUSPENSIONS) (No. 2) REGULATIONS, 1978.

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Recommendations No. 859/78/ECSC1 of the 27th day of April, 1978, No. 931/78/ECSC2 of the 28th day of April, 1978 and No. 1716/78/ECSC3 of the 20th day of July, 1978, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Provisional Anti-Dumping Duties) (Miscellaneous Suspensions) (No. 2) Regulations, 1978.

2. (1) The provisional anti-dumping duties imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Iron and Steel Goods) Regulations, 1978 ( S.I. No. 306 of 1978 ), on goods of the description specified in those Regulations shall not be charged or levied on any goods of that description which are imported into the State and which originate in Czechoslovakia.

(2) This Article shall be deemed to have come into operation on the 28th day of April, 1978.

3. (1) The provisional anti-dumping duties imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Iron and Steel Goods) Regulations, 1978, on goods of the description specified in those Regulations shall not be charged or levied on any goods of that description which are imported into the State and which originate in Spain.

(2) This Article shall be deemed to have come into operation on the 4th day of May, 1978.

4. (1) The provisional anti-dumping duties imposed by the European Communities (Imposition of Provisional Anti-Dumping Duty on Certain Iron and Steel Goods) (No. 2) Regulations, 1978 ( S.I. No. 308 of 1978 ), on goods of the description specified in those Regulations shall not be charged or levied on any goods of that description which are imported into the State and which originate in Australia.

(2) This Article shall be deemed to have come into operation on the 22nd day of July, 1978.

5. For the purposes of these Regulations, the country of origin of goods shall be determined in accordance with the rules of origin contained in Council Regulation E.E.C. No. 802/684 of the 27th day of June, 1968 (as amended).

EXPLANATORY NOTE.

These Regulations provide for the suspension of the application of the provisional anti-dumping duties imposed by the Regulations referred to in Paragraphs (2), (3) and (4) above in relation to or insofar as they relate to imports of certain iron or steel products originating in Czechoslovakia, Spain and Australia respectively.
