VOCATIONAL EDUCATION (CONTRACTS) (AMENDMENT) REGULATIONS, 1978.

I, JOHN P. WILSON, Minister for Education, in exercise of the powers conferred on me by section 125 (1) of the Vocational Education Act, 1930 (No. 29 of 1930), hereby make the following regulations:

1. These Regulations may be cited as the Vocational Education (Contracts) (Amendment) Regulations, 1978.

2. These Regulations shall have effect in relation to contracts entered into by vocational education committees on or after the 1st day of March 1978.

3. The Interpretation Act, 1937 , (No. 38 of 1937), applies to these Regulations.

4. In these Regulations "the Regulations of 1964" means the Vocational Education (Contracts) (Amendment) Regulations, 1964 ( S.I. No. 234 of 1964 ).

5. The Vocational Education (Contracts) Regulations, 1931 (S. R. & O., No. 36 of 1931), are hereby amended by:—

( a ) the substitution in Regulation 4 for "seventy pounds" (inserted by the Regulations of 1964) of "one hundred and forty pounds",

( b ) the substitution in Regulation 6 for "one hundred and seventy-five pounds", (inserted by the Regulations of 1964) of "three hundred and fifty pounds'',and

( c ) the substitution in Regulation 7 for "three hundred and fifty pounds" (inserted by the Regulations of 1964) of "seven hundred pounds",

and the said Regulations 4, 6 and 7, as so amended, are set out in the Table to this Regulation.

Regulation 4.

Every contract (other than a contract the value or amount whereof does not exceed one hundred and forty pounds) made by a committee for the execution of any work shall specify the work to be done, the materials (if any) to be supplied, the prices to be paid by the Committee for such work and materials respectively, the time within which the contract is to be performed, and the penalties for failure or delay in the performance thereof.

Regulation 6.

Before entering into a contract involving the payment by a committee of a sum of three hundred and fifty pounds or any greater sum, such committee shall cause not less than ten days' public notice by advertisement or otherwise to be given stating the nature and purpose of such contract and inviting tenders for the execution thereof.

Regulation 7.

Before entering into any contract involving the payment by a committee of the sum of seven hundred pounds or any greater sum, such committee shall require and take from the person by whom such contract is to be performed sufficient security for the due performance thereof.
