INTERNATIONAL FUND FOR AGRICULTURAL DEVELOPMENT (DESIGNATION OF ORGANISATION) ORDER, 1977.

WHEREAS it is enacted by section 40 (1) of the Diplomatic Relations and Immunities Act, 1967 (No. 8 of 1967), that the Government may by order designate an international organisation of which the State or the Government is or intends to become a member to be an organisation to which Part VIII of that Act applies:

AND WHEREAS the International Fund for Agricultural Development is an organisation such as aforesaid:

NOW, the Government, in exercise of the powers conferred on them by section 40 of the said Diplomatic Relations and Immunities Act, 1967 , hereby order as follows:

1. This Order may be cited as the International Fund for Agricultural Development (Designation of Organisation) Order, 1977.

2. The International Fund for Agricultural Development is hereby designated as an organisation to which Part VIII of the Diplomatic Relations and Immunities Act, 1967 (No. 8 of 1967), applies.

3. Section 2 of Article 10 (the terms of which are set out in the Schedule to this Order) of the Agreement establishing the International Fund for Agricultural Development adopted on the 13th day of June, 1976, by the United Nations Conference on the Establishment of an International Fund for Agricultural Development at Rome shall apply for the purposes of section 42 of the Diplomatic Relations and Immunities Act, 1967 .

Privileges and Immunities

(a) The Fund shall enjoy in the territory of each of its Members such privileges and immunities as are necessary for the exercise of its functions and for the fulfilment of its objective. Representatives of Members, the President and the staff of the Fund shall enjoy such privileges and immunities as are necessary for the independent exercise of their functions in connection with the Fund.

(b) The privileges and immunities referred to in paragraph (a) shall:

(i) in the territory of any Member that has acceded to the Convention on the Privileges and Immunities of the Specialised Agencies in respect of the Fund, be as defined in the standard clauses of that Convention as modified by an annex thereto approved by the Governing Council;

(ii) in the territory of any Member that has acceded to the Convention on the Privileges and Immunities of the Specialised Agencies only in respect of agencies other than the Fund, be as defined in the standard clauses of that Convention, except if such Member notifies the Depositary that such clauses shall not apply to the Fund or shall apply subject to such modifications as may be specified in the notification;

(iii) be as defined in other agreements entered into by the Fund.

(c) In respect of a Member that is a grouping of States, it shall ensure that the privileges and immunities referred to in this Article are applied in the territories of all members of the grouping.

EXPLANATORY NOTE.

The effect of this order is to confer on the International Fund for Agricultural Development the status of a body corporate and to enable it to enjoy certain privileges and immunities for which provision is made by the Agreement establishing it.
