ROAD TRAFFIC (SPEED LIMITS) (COUNTY OF WEXFORD) REGULATIONS, 1977.

The Minister for Local Government in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County of Wexford) Regulations, 1977.

2 Commencement.

2. These Regulations shall come into operation on the 8th day of August, 1977.

3 Interpretation.

3. In these Regulations save where the context otherwise requires "the Act" means the Road Traffic Act, 1961 ;

"road" means a public road;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

"distance" means distance as measured along the centre line of a road.

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be expected from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocations.

7. The Road Traffic (Speed Limits) (County of Wexford) Regulations, 1968 ( S.I. No. 153 of 1968 ) are hereby revoked.

FIRST SCHEDULE.

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Enniscorthy:

( a ) Boreen Hill,

( b ) Island Street and its continuation as the Dublin Road between the urban district boundary and a point 5 metres south of the junction of the Dublin Road with Boreen Hill,

( c ) Nunnery Road between the urban district boundary and a point 73 metres north of its northernmost junction with the Fair Green,

( d ) The Esmonde Road between its southernmost intersection by the urban district boundary and a point 23 metres from its junction with the Spring Valley Road,

( e ) The New Ross Road between the urban district boundary and a point 182 metres north of Arnold's Cross.

2. The following roads in the town of Gorey:

( a ) The Ramsfort Park Road, Leatherfactory Road, The Mill Road,

( b ) The Enniscorthy Road for a distance of 300 metres from the town boundary,

( c ) The Fort Road between the town boundary and a point 329 metres north-west of its junction with the Coislinne Road,

( d ) The Arklow Road for a distance of 146 metres from the town boundary,

( e ) The Coach Road between the town boundary and a point 46 metres north of its junction with the Clonattin Road,

( f ) The Courtown Road between the town boundary and a point 46 metres north of its junction with the Mill Road,

( g ) The Clonattin Road for a distance of 183 metres from the point where the town boundary intersects with the northern side of the road,

( h ) The Ballycanew Road between the town boundary and a point 32 metres south of its junction with the Railway Road.

3. The following roads in the Urban District of New Ross:

( a ) The Chilcomb Road, Lovers Lane, The Ballylane Road,

( b ) The Schoolhouse Road for a distance of 128 metres from its junction with the Chilcomb Road,

( c ) Rosbercon Hill for a distance of 27 metres from the urban district boundary,

( d ) The Enniscorthy or Cherry's Road for a distance of 457 metres from the urban district boundary,

( e ) Bosheen Na Slan between the urban district boundary and a point 140 metres south of its junction with Irishtown,

( f ) The road continuing eastwards from Wexford Street between the urban district boundary and a point 182 metres west of the junction of the said road with the Ballylane Road,

( g ) The Campile or Wexford Road for a distance of 228 metres from the urban district boundary.

4. The following roads in the Borough of Wexford:

( a ) The Redmond or New Road for a distance of 539 metres from the borough boundary,

( b ) The Mulgannon Road where the said road is a perimeter road.

SECOND SCHEDULE.

Roads declared to be public roads in a built-up area for the purposes of Section 45 of the Road Traffic Act, 1961 .

1. The following road at Ballyaghkeen:

The Enniscorthy-Castle Ellis road between a point 500 metres north-west of its junction with the Killesk Road and a point 80 metres north-east of the said junction.

2. The following roads at Ballycanew:

( a ) The Ballycanew Housing Estate Road,

( b ) Ballycanew Street and its continuation as the Gorey Road between its junction with the Wexford Road and a point 5 metres north of its junction with the Ballycanew Housing Estate Road,

( c ) The Coolook Road for a distance of 192 metres from its junction with Ballycanew Street,

( d ) The Wexford Road for a distance of 23 metres from its junction with the Tomgar or Ballymore Road,

( e ) The Tomgar or Ballymore Road for a distance of 23 metres from its junction with the Wexford Road.

3. The following road at Ballycullane:

The Kinnagh-Boley (Main Street) road for a distance of 460 metres north-west of its junction with the Taylorstown Road.

4. The following roads at Ballymurn:

( a ) The Enniscorthy-Curracloe road between a point 45 metres north-west of its junction with the Oylegate Road and a point 180 metres south-east of the said junction,

( b ) The Ballina Upper Road for a distance of 150 metres from its junction with the Enniscorthy-Curracloe road.

5. The following roads at Blackwater:

( a ) The Wexford-Gorey (Coast) Road between a point 90 metres north-east of its junction with the Beach Road and a point 340 metres south of its junction with the Enniscorthy Road,

( b ) The Enniscorthy Road for a distance of 385 metres from its junction with the Wexford-Gorey (Coast) road.

6. The following road at Bree:

The Knocknagross-Clough road between a point 270 metres north-east of its junction with the Sparrowsland Road and a point 240 metres south of the said junction.

7. The following roads at Bridgetown:

( a ) The Rosslare-Wellingtonbridge road between a point 275 metres west of its junction with the Wexford Road and a point 445 metres east of its junction with the Kilmore Road,

( b ) The Wexford Road for a distance of 225 metres from its junction with the Rosslare-Wellingtonbridge road,

( c ) The Mulranking Road for a distance of 95 metres from its junction with the Rosslare-Wellingtonbridge road,

( d ) The Kilmore Road between its junction with the Rosslare-Wellingtonbridge road and a point 250 metres south-east of its junction with the Ballycross Road,

( e ) The Ballycross Road for a distance of 100 metres from its junction with the Kilmore Road.

8. The following roads at Bunclody:

( a ) Chapel Lane, The Mall, Market Square, St. Mary's Villas,

( b ) Ryland Street and its continuation as the Ryland Road for a distance of 238 metres from its junction with Irish Street,

( c ) Irish Street and its continuation as the New Ross or Kiltealy Road for a distance of 330 metres from its junction with Ryland Street,

( d ) Church Street and its continuation as the Mill Road for a distance of 458 metres from its junction with The Mall,

( e ) The Carrickduff Road between its junction with The Mall and the boundary between the counties of Wexford and Carlow at Clody Bridge,

( f ) The Carnew Road for a distance of 93 metres from its junction with Ryland Street.

9. The following roads at Campile:

( a ) Campile Housing estate roads, Abbey View Road, St. James Villas Housing estate roads,

( b ) The Horeswood Road for a distance of 690 metres from its junction with the Dunmain Road,

( c ) The Fethard Road for a distance of 412 metres from its junction with the Dunmain Road,

( d ) The Dunmain Road for a distance of 156 metres from its junction with the Horeswood Road.

10. The following road at Carrig-on-Bannow:

The Danescastle-Bannow road between a point 28 metres south of its junction with the Duncormick-Wellingtonbridge road and a point 485 metres north-east of the said junction.

11. The following roads at Castlebridge:

( a ) The Crossabeg-Wexford road between a point 360 metres north-west of its junction with the Ballyboggan Road and a point 365 metres south of its junction with the Ardcolm Road,

( b ) The Ballyboggan Road for a distance of 210 metres from its junction with the Crossabeg-Wexford road,

( c ) Chapel Road for a distance of 155 metres from its junction with the Crossabeg-Wexford road,

( d ) The Gorey Road for a distance of 155 metres from its junction with the Crossabeg-Wexford road.

( e ) The Ardcolm Road for a distance of 55 metres from its junction with the Crossabeg-Wexford road.

12. The following road at Clonegal:

The Bunclody Road for a distance of 75 metres from the boundary between the counties of Carlow and Wexford at Clonegal Bridge.

13. The following roads at Courtown, Riverchapel and Ardamine:

All roads in the area enclosed by a line commencing at the point on the eastern edge of the Borough Road where the said road terminates at the footbridge over the Owenavorragh River and drawn thence in straight lines successively to the following points:—

( a ) the seaward terminal point of the south pier, Courtown Harbour,

( b ) a point on the Ardamine Road 230 metres south-east of its junction with the Middletown Road,

( c ) a point on the Middleton Road 640 metres south-west of its junction with the Ardamine Road,

( d ) a point on the western edge of Red Row 275 metres north of its junction with the Ardamine Road,

( e ) a point on the Gorey Road 366 metres north-west of its junction with the Ardamine Road,

( f ) a point on the Levuka Road 183 metres north-west of its junction with the Gorey Road,

of the last-mentioned point

( g ) a point on the western edge of the Borough Road due east

and thence in a northerly direction along the said western edge of the Borough Road to the point where the said road terminates at the footbridge over the Owenavorragh River and from that point in a straight line to the commencement point on the eastern edge of the said road.

14. The following roads at Curracloe:

( a ) The Fahy's Cross-Blackwater road between a point 195 metres west of its junction with the Coolrainey Road and a point 185 metres north-east of the said junction,

( b ) The Coolrainey Road for a distance of 250 metres from its junction with the Fahy's Cross-Blackwater road.

15. The following roads at Duncannon:

( a ) The Fethard-Athurstown road between a point 46 metres east of its junction with Strand Road and a point 75 metres north-west of its junction with Main Street,

( b ) Strand Road and its continuation to Duncannon Quay,

( c ) Main Street and its continuation to Duncannon Quay.

16. The following roads adjacent to the Urban District of Enniscorthy:

( a ) Drumgoold Villas Road,

( b ) Bellfield Road for a distance of 440 metres from the point where the boundary of the urban district of Enniscorthy intersects the southern side of the road,

( c ) The Ross Road for a distance of 55 metres from the boundary of the urban district of Enniscorthy,

( d ) The Salvill Road where the said road is a perimeter road,

( e ) The Esmonde Road for a distance of 23 metres from its junction with the Spring Valley Road,

( f ) The " Shannon " between the point where the urban district boundary of Enniscorthy intersects the northern side of the road and a point 80 metres west of its junction with the Aughnagally Road,

( g ) The Old Church or Rectory Road for a distance of 320 metres from the boundary of the urban district of Enniscorthy,

( h ) The Oulart Road for a distance of 230 metres from the boundary of the urban district of Enniscorthy,

( i ) The part of the Spring Valley Road which lies outside the boundary of the urban district of Enniscorthy,

( j ) Munster Hill for a distance of 137 metres from the boundary of the urban district of Enniscorthy.

17. The following roads at Ferns:

All roads (other than the roads set out at reference 6 in the Third Schedule to these Regulations) enclosed by a line commencing at a point on the Gorey Road 366 metres north-east of its junction with Station Road and drawn thence in straight lines successively to the following points:—

( a ) a point on the Station Road 5 metres west of its junction with the Killoggy Road,

( b ) a point on the Enniscorthy Road 128 metres north-east of the Vee Cross,

( c ) a point on the road connecting the Vee Cross with the Bunclody Road 137 metres north-east of the Vee Cross.

( d ) a point on the Bunclody Road 512 metres west of its junction with the Enniscorthy Road,

( e ) a point on the Newtown Road 183 metres north-west of its junction with the Bunclody Road,

( f ) the northern terminal point of the road leading northwards from the Bunclody Road at the junction of the Bunclody Road with the Newtown Road,

and from the last-mentioned point in a straight line to the commencement point on the Gorey Road.

18. The following roads at Fethard-on-Sea:

( a ) The Main Street between a point 495 metres north-west of its junction with the Hook Road and a point 395 metres south-east of the said junction,

( b ) The Hook Road for a distance of 165 metres from its junction with the Main Street,

( c ) The Grange Strand Road for a distance of 95 metres from its junction with the Main Street.

19. The following roads adjacent to the town of Gorey:

( a ) The Garden City Road between the boundary of the town of Gorey and a point 20 metres south-west of its junction with the Knockina Road,

( b ) The Clonattin Road between the point where the boundary of the town of Gorey intersects the southern side of the road and a point 183 metres west of the point where the said boundary intersects the northern side of the road,

( c ) The Carnew Road for a distance of 460 metres west from the boundary of the town of Gorey.

20. The following roads at Kilmore Village:—

( a ) The Wexford-Kilmore Quay road between a point 520 metres south-west of its junction with the Lannagh Road and a point 120 metres north-east of its junction with the Bridgetown Road,

( b ) The Lannagh Road for a distance of 85 metres from its junction with the Wexford-Kilmore Quay road,

( c ) The Bridgetown Road for a distance of 110 metres from its junction with the Wexford-Kilmore Quay road,

( d ) The Newtown Road for a distance of 85 metres from its junction with the Wexford-Kilmore Quay road.

21. The following roads at Kilmore Quay:

( a ) The Kilmore Road for a distance of 830 metres from its junction with the Baldwinstown Road,

( b ) The Baldwinstown Road for a distance of 490 metres from its junction with the Kilmore Road.

22. The following roads in Kilmuckridge:

( a ) The Courtown-Blackwater road between a point 405 metres north east of the centre line of the bridge in Kilmuckridge to a point 735 metres south-west of the said centre line,

( b ) The Kilnamanagh road for a distance of 230 metres from its junction with the Courtown-Blackwater road,

( c ) The Morriscastle road for a distance of 95 metres from its junction with the Courtown-Blackwater road.

23. The following roads adjacent to the Urban District of New Ross:

( a ) Charlton Hill and its continuation as the Hospital Road for a distance of 495 metres from the boundary of the urban district of New Ross,

( b ) The Old Ross Road for a distance of 18 metres from the boundary of the urban district of New Ross.

24. The following roads at Oulart:

( a ) The Enniscorthy-Kyle road between a point 145 metres west of its junction with the Kilnamanagh Road and a point 200 metres east of the said junction,

( b ) The Kilnamanagh Road for a distance of 430 metres from its junction with the Enniscorthy-Kyle road.

25. The following roads at Oylgate:

( a ) The Wexford-Enniscorthy road between a point 192 metres south of its junction with the Ballymurn Road and a point 165 metres north of the said junction,

( b ) The Ballymurn Road for a distance of 256 metres from its junction with the Wexford-Enniscorthy road.

26. The following roads at Rosslare:

( a ) Strand Road, Burmah Road, Grange Road, Railway Road,

( b ) The Wexford Road for a distance of 95 metres from its junction with Railway Road.

27. The following roads at Screen:

( a ) The Enniscorthy-Curracloe road between a point 185 metres north of its junction with the Blackwater Road and a point 310 metres south of the said junction,

( b ) The Blackwater Road for a distance of 175 metres from its junction with the Enniscorthy-Curracloe road.

28. The following roads at Taghmon:

( a ) Back or Stream Street, Joseph's Street, Castle Alley, Green Gardens, Main Street, Fair Green,

( b ) The Hillburn Road between its junction with Joseph's Street and a point 247 metres west of its junction with the Mulmontry Road,

( c ) The Wexford Road for a distance of 125 metres from its junction with Back Street,

( d ) The New Ross Road for a distance of 183 metres from its junction with Main Street,

( e ) The road connecting Main Street with Back Street,

( f ) Chapel Street and its continuation as the Brownscastle Road for a distance of 230 metres from the junction of Chapel Street with Back Street,

( g ) The Forest Road for a distance of 46 metres from its junction with the Brownscastle Road,

( h ) The Mulmontry Road for a distance of 247 metres from its junction with the Hillburn Road.

29. The following roads adjacent to the Borough of Wexford:

( a ) The Whitemill Road, The Dolphin Road,

( b ) The Spawell Road between the point where the boundary of the borough of Wexford intersects the northern side of the road and a point 32 metres south-east of its junction with the Enniscorthy Road,

( c ) The Coolcots Road for a distance of 137 metres from its junction with the Belvedere Road,

( d ) The part of the Belvedere Road and its continuation southward which lies outside the boundary of the borough of Wexford,

( e ) The Clonard Road for a distance of 683 metres from its junction with the Belvedere Road,

( f ) The road in the Ard Carmain Housing Estate,

( g ) The Duncannon Line where the said road is a perimeter road,

( h ) The Whiterock Road where the said road is a perimeter road,

THIRD SCHEDULE.

Roads in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads at Bunclody:

( a ) Ryland Street and its continuation as the Ryland Road between a point 238 metres from its junction with Irish Street and a point 550 metres from the said junction,

( b ) The Kiltealy Road between a point 330 metres from its junction with Ryland Street and a point 897 metres from the said junction.

2. The following road at Caim:

The Enniscorthy-Killann road between a point 20 metres east of its junction with the Kiltra-Drannagh road and a point 570 metres east of the said junction.

3. The following roads at Camolin:

( a ) The Gorey-Ferns road between a point 138 metres north-east of its junction with the Newbridge Road or Limerick Lane and a point 110 metres south-west of its junction with Railway Road,

( b ) The Newbridge Road or Limerick Lane for a distance of 320 metres from its junction with the Gorey-Ferns road,

( c ) The Ballyduff Road for a distance of 92 metres from its junction with the Gorey-Ferns road,

( d ) Railway Road for a distance of 138 metres from its junction with the Gorey-Ferns road.

4. The following roads at Clonroche:

( a ) The New Ross-Enniscorthy road between a point 640 metres south-west of its junction with Chapel Road and a point 403 metres north-east of the said junction,

( b ) Chapel Road for a distance of 65 metres from its junction with the New Ross-Enniscorthy road,

( c ) The Ballywilliam or Cloughbawn Road for a distance of 46 metres from its junction wit hthe New Ross-Enniscorthy load.

5. The following roads in and adjacent to the Urban District of Enniscorthy:

( a ) Boreen Hill,

( b ) Island Street and its continuation as the Dublin Road between a point 5 metres south of the junction of the Dublin Road with Boreen Hill and a point 1,620 metres north of the junction of the Dublin Road with Nunnery Road,

( c ) The Moyne Road for a distance of 46 metres from its junction with Nunnery Road,

( d ) Nunnery Road between its junction with the Dublin Road and a point 73 metres north of its northernmost junction with the Fair Green,

( e ) The Esmond Road between a point 23 metres south of its junction with the Spring Valley Road and a point 285 metres west of its junction with the Ballycoursey-More-Drumgoold road,

( f ) Old Church (or Rectory) Road between a point 320 metres north-east of the boundary of the urban district of Enniscorthy and a point 37 metres west of its junction with the Oulart Road.

6. The following roads at Ferns:

( a ) The Gorey Road between a point 68 metres north-east of its junction with the Station Road and a point 366 metres north-east of the said junction,

( b ) The Enniscorthy Road between a point 128 metres north-east of the Vee Cross and a point 22 metres south-west of its junction with the Bunclody Road.

7. The following road at Eoulksmills:

The Main Taghmon-Ballincholla road between a point 20 metres west of the centre line of Foulksmills Bridge and a point 45 metres west of its junction with the Clongeen Road.

8. The following roads in and adjacent to the town of Gorey:

( a ) The Enniscorthy Road for a distance of 300 metres north-east of the boundary of the town of Gorey,

( b ) The Arklow Road between a point 146 metres south-west of the boundary of the town of Gorey and a point 138 metres north-east of its junction with the Coach Road,

( c ) The Coach Road between its junction with the Arklow Road and a point 46 metres north of its junction with the Clonattin Road,

( d ) The Knockina Road for a distance of 23 metres from its junction with the Arklow Road,

( e ) The Leatherfactory Road for a distance of 95 metres from its junction with the Enniscorthy Road.

9. The following roads at Kilrane:

( a ) The Rosslare Harbour Road between a point 30 metres west of its junction with St. Helens Road and a point 220 metres west of its junction with Barrack's Cross Road,

( b ) Our Lady's Island Road for a distance of 75 metres from its junction with the Rosslare Harbour Road,

( c ) Kilrane Station Road for a distance of 75 metres from its junction with the Rosslare Harbour Road.

10. The following roads in and adjacent to the Urban District of New Ross:

( a ) The Enniscorthy or Cherry's Road between a point 182 metres south-west of the boundary of the urban district of New Ross and a point 457 metres south-west of the said boundary,

( b ) The Old Ross Road between a point 18 metres east of the boundary of the urban district of New Ross and a point 5 metres south-west of the centre line of Maudlins Bridge.

11. The following road at Rathnure:

The Kiltealy-New Ross road between a point 340 metres north-east of its junction with the Grange Upper Road and a point 110 metres south-west of the said junction.

12. The following road at Tomnalossett, Enniscorthy:

The Enniscorthy-Ballygillistown road for a distance of 1,110 metres south of its junction with the Enniscorthy-Bree road.

13. The following roads in and adjacent to the Borough of Wexford:

( a ) The Newtown Road between a point 230 metres west of the boundary of the borough of Wexford and a point 685 metres west of the said boundary,

( b ) The Redmond or New Road between a point 539 metres south-east of the boundary of the Borough of Wexford and a point 173 metres south-east of the said boundary,

( c ) The Maudlinton or Rosslare Road between a point 20 metres south of its junction with the Dolphin Road and a point 385 metres south of the said junction,

( d ) The Duncannon Line between the point where the boundary of the borough of Wexford intersects the northern side of the road and a point 75 metres south-west of its junction with the Whitemill Road,

( e ) The Clonard Road between a point 1,000 metres west of its junction with the Belvedere Road and a point 683 metres west of the said junction.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits), County of Wexford) Regulations, 1968 ( S.I. No. 153 of 1968 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit prescribed by section 45 of the Road Traffic Act, 1961 , and declare the public roads mentioned in the Second Schedule to the subject to that speed limit.

The Regulations also prescribe a speed limit of 40 miles per hour in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
