IMPOSITION OF DUTIES (DUMPING AND SUBSIDIES) (No. 11) (ANTI-DUMPING DUTY ON PENCILS) ORDER, 1977.

WHEREAS, as a result of an investigation by An Coimisiún Dumpála under section 7 of the Imposition of Duties (Dumping and Subsidies) Act, 1968 (No. 11 of 1968), in relation to goods of the kind specified in Article 3 of the Order following, that Commission recommended to the Minister for Industry and Commerce that an anti-dumping duty at the rate of £1.49 per gross be imposed on goods of the kind aforesaid:

AND WHEREAS the Minister for Industry and Commerce is satisfied that there has been injurious dumping of goods of the kind aforesaid and that the dumping has caused material injury to an industry in the State:

NOW, THEREFORE, the Government in exercise of the powers conferred on them by section 14 of the said Imposition of Duties (Dumping and Subsidies) Act, 1968 , hereby order as follows:

1. This Order may be cited as the Imposition of Duties (Dumping and Subsidies) (No. 11) (Anti-Dumping Duty on Pencils) Order, 1977.

2. This Order shall come into operation on the 28th day of June, 1977.

3. An anti-dumping duty at the rate of £1.49 per gross shall be charged, levied and paid on wood-cased pencils that are—

( a ) produced in, or originate in, Czechoslovakia, and

( b ) classified at tariff code numbers 9805-416 and 9805-424 in the Schedule to the Imposition of Duties (No. 200) (Customs and Excise Duties and Form of Tariff) Order, 1972 ( S.I. No. 220 of 1972 ), and

( c ) imported into the State after the commencement of this Order.

4. For the purposes of this Order, the country of origin of goods shall be determined in accordance with the rules of origin contained in Regulation (EEC) No. 802/68 of the Council.*

5. The duty imposed by this Order is hereby placed under the care and management of the Revenue Commissioners.

EXPLANATORY NOTE.

This Order provides for the charging of an anti-dumping duty at the rate of £1.49 per gross on wood-cased pencils which are produced in or which originate in Czechoslovakia.
