EUROPEAN COMMUNITIES (FRESH POULTRY MEAT) REGULATIONS, 1975.

I, MARK CLINTON, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Fresh Poultry Meat) Regulations, 1975.

(2) The European Communities (Fresh Poultry Meat) Regulations, 1973 ( S.I. No. 129 of 1973 ), and these Regulations may be cited together as the European Communities (Fresh Poultry Meat) Regulations, 1973 and 1975.

2. These Regulations shall come into operation on the 1st day of September, 1975.

3. The European Communities (Fresh Poultry Meat) Regulations, 1973, are hereby amended—

( a ) by the insertion after Regulation 7 of the following Regulation:

"7A. An officer of customs and excise may detain and seize any fresh poultry meat being exported or attempted to be imported or exported in contravention of these Regulations or of any Community Regulation relating to fresh poultry meat and may for that purpose open any package containing or suspected by him to contain fresh poultry meat, and the provisions of the Customs Consolidation Act, 1876, relating to the condemnation and disposal of goods seized under that Act shall apply and have effect in relation to all articles seized under this Regulation as if the articles had been seized under that Act.", and

( b ) the insertion in Regulation 11 after "fresh poultry meat" of "exported to a member state."

EXPLANATORY NOTE.

The regulations (a) empower customs and excise officers to detain and seize fresh poultry meat being exported or attempted to be imported or exported in contravention of relevant Community provisions and (b) enable the Minister to grant licences and permits for the export of fresh poultry meat to third countries and to attach conditions to such licences and permits.
