SOCIAL WELFARE (CHILDREN'S ALLOWANCES) (GENERAL) (AMENDMENT) REGULATIONS, 1974.

The Minister for Social Welfare, in exercise of the powers conferred on him by section 20 of the Children's Allowances Act, 1944 (No. 2 of 1944) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Social Welfare (Children's Allowances) (General) (Amendment) Regulations, 1974.

(2) These Regulations and the Social Welfare (Children's Allowances) (General) Regulations, 1952, may be cited together as the Social Welfare (Children's Allowances) (General) Regulations, 1952 to 1974.

2. These Regulations shall come into operation on the 3rd day of July, 1974.

3. In these Regulations "the Principal Regulation" means the Social Welfare (Children's Allowances) (General) Regulations, 1952 ( S.I. No. 222 of 1952 ).

4. Article 3 of the Principal Regulations is hereby deleted and the following substituted therefor:—

"3. A claim for a children's allowance or a claim in relation to a qualified child of whom account has not been taken in computing the rate of children's allowance to which the claimant is for the time being entitled shall be made by the qualified person in such manner as the Minister may determine."

5. Article 4 of the Principal Regulations is hereby amended by the deletion of the words "or attested" following the words "duly signed".

6. Article 7 of the Principal Regulations is hereby amended by the deletion of the words "paragraph (1) of" preceding the words "Regulation 3 hereof".

7. Article 11 of the Principal Regulations is hereby amended by—

( a ) the deletion of the word "mother" in sub-article 1 (a) thereof and the substitution therefor of the words "father or step-father".

( b ) the deletion of sub-article (2) (i) and the substitution of the following therefor:—

"(i) shall be in such form as the Minister may determine".

8. The Principal Regulations are hereby amended by the deletion of the Schedule thereto.

EXPLANATORY NOTE.

These Regulations provide that a claim for a children's allowance must be made by the qualified person, that is, usually, the mother with whom the child is regarded as being normally resident. Provision is made that the father or step-father of a child may be nominated to receive the children's allowance. The Regulations also provide that a claim may be made in such manner as the Minister may determine rather than on the form prescribed in the Schedule being deleted.
