FUELS (CONTROL OF SUPPLIES) (RESTRICTION ON DELIVERIES OF GAS DIESEL OIL, KEROSENE AND FUEL OIL) (AMENDMENT) ORDER, 1973.

The Minister for Transport and Power, in exercise of the powers conferred on him by section 3 of the Fuels (Control of Supplies) Act, 1971 (No. 3 of 1971), hereby orders as follows:—

1. This Order may be cited as the Fuels (Control of Supplies) (Restriction on Deliveries of Gas Diesel Oil, Kerosene and Fuel Oil) (Amendment) Order, 1973.

2. The Fuels (Control of Supplies) (Restriction on Deliveries of Gas Diesel Oil, Kerosene and Fuel Oil) Order, 1973 ( S.I. No. 306 of 1973 ) is hereby amended—

( a ) by the substitution for paragraph (c) of Article 2 of the following paragraph—

"( c ) where a consumer—

(i) did not receive a supply of gas diesel oil, kerosene or fuel oil before the first day of October, 1972, or

(ii) increased or decreased his business significantly or changed the character of his business on or after that date,

such amount as shall be deemed appropriate by the Minister, after consultation with the oil wholesaler or distributor concerned, taking into account deliveries to comparable consumers in the six months ended on the 31st day of March, 1973",

( b ) by the substitution for Article 3 of the following Articles—

"3. In the period of six months ending on the 31st day of March, 1974, the amount of gas diesel oil, kerosene or fuel oil delivered by an oil wholesaler to a distributor or any other person or by a distributor to any person shall not exceed the following percentages of that person's normal deliveries—

( a ) 92½ per cent. when required for horticulture or for agriculture,

( b ) 78 per cent. when required for domestic heating.

3A. In the period of four months ending on the 31st day of January, 1974, the amount of gas diesel oil, kerosene or fuel oil delivered by an oil wholesaler to a distributor or any other person or by a distributor to any person shall not exceed the following percentages of that person's normal deliveries—

( a ) 66 2/3 per cent. when required for use as a raw material for industry,

( b ) 62½ per cent. when required for industrial processing or for commercial fishing, building construction, general civil engineering or commercial transport,

( c ) 61½ per cent. when required for ships bunkers,

( d ) 53½ per cent. when required for space heating in an institution, office, shop, factory, public hall, educational establishment, religious premises, catering establishment, hotel, guest house or place of entertainment, recreation or sport,

( e ) 52 per cent. when required for use in connection with public swimming pools, and

( f ) 47½ per cent. when required for use in unoccupied buildings or new houses intended for use as dwellings but not being so used or for use in connection with pleasure boating, pleasure flying, motor car and motor cycle competitions of any kind or for any use not otherwise specified in this Article or in Article 3 of this Order.".

( c ) by the substitution for subparagraph (i) of Article 6 of the following paragraph—

"(i) deliveries of gas diesel oil, kerosene or fuel oil when required for the manufacture of electricity or gas", and

( d ) by the substitution in Articles 4 and 6 of "Articles 3 and 3A" for "Article 3".

EXPLANATORY NOTE.

This Order amends the Fuels (Control of Supplies) (Restriction on Deliveries of Gas Diesel Oil, Kerosene and Fuel Oil) Order, 1973. Paragraph 2 sets out the maximum level of normal deliveries to be made in the four-month period up to 31st January, 1974 or in some instances the six-month period up to 31st March, 1974.

Where a domestic consumer received a supply of gas diesel oil, kerosene or fuel oil before 1st October, 1972, the amount received by him in the six months ended on the 31st March, 1973 shall be considered his "normal delivery".

Where a non-domestic consumer received a supply of gas diesel oil, kerosene or fuel oil before 1st October, 1972, and has not changed the nature of his business since that date, the amount received by him in the six months ended on 31st March, 1973, shall be considered his "normal delivery".

Where a consumer did not get a supply of gas diesel oil, kerosene or fuel oil before 1st October, 1972, or increased or decreased his business significantly or changed the character of his business on or after that date, his "normal delivery" shall be such as is deemed appropriate by the Minister after consultation with the oil wholesaler or distributor.
