COURTS (SUPPLEMENTAL PROVISIONS) ACT, 1961 (SECTION 46) ORDER, 1973.

The Government, in exercise of the powers conferred on them by section 46 of the Courts (Supplemental Provisions) Act, 1961 (No. 39 of 1961), as amended by section 1 of the Courts (Supplemental Provisions) (Amendment) (No. 2) Act, 1968 (No. 21 of 1968), hereby make the following order with respect to which pursuant to the said section 46, as amended as aforesaid, a draft has been laid before Dáil Éireann and a resolution disapproving of the draft has not been passed by Dáil Éireann within the next subsequent twenty-one days on which it has sat after the draft was laid before it:

1. This Order may be cited as the Courts (Supplemental Provisions) Act, 1961 (Section 46) Order, 1973.

2. (1) The sums payable by way of remuneration to the several judges of the Supreme Court, the High Court and the Circuit Court and the several justices of the District Court shall, in accordance with the terms of the Employer-Labour Conference National Agreement made on the 21st day of December, 1970, and the Employer-Labour Conference National Agreement made on the 31st day of July, 1972, be increased—

( a ) by the sum of £104 per annum as on and from the 1st day of January, 1972, and

( b ) by 4% of the sums payable by way of remuneration immediately before the 1st day of January, 1973, as on and from the 1st day of January, 1973, and

( c ) by the sum of £33 per annum as on and from the 1st day of January, 1973,

( d ) (i) by 9% of £1,566 of the sums payable by way of remuneration immediately before the 1st day of June, 1973,

(ii) by 7½% of £522 of such sums,

(iii) by 4% of the remainder of such sums, and

(iv) by the sum of £5 per annum, as on and from the 1st day of June, 1973, and

( e ) by the sum of £5 per annum as on and from the 1st day of July, 1973.

(2) Where a sum payable by way of remuneration referred to in paragraph (1) of this Article as increased by that paragraph is not a multiple of £5, the sum shall be rounded up or down to the nearest multiple of £5, any broken amount of £2·50 or more being rounded up and any broken amount of less than £2·50 being rounded down.
