BRUCELLOSIS IN CATTLE (DISEASE-FREE AREA) (AMENDMENT) ORDER, 1973.

I, MARK CLINTON, Minister for Agriculture and Fisheries, it appearing to me to be necessary for the purpose of the progressive eradication of brucellosis in cattle, do hereby, in exercise of the powers conferred on me by sections 3 and 20 of the Diseases of Animals Act, 1966 (No. 6 of 1966), order as follows:

1. (1) This Order may be cited as the Brucellosis in Cattle (Disease-Free Area) (Amendment) Order, 1973.

(2) The Brucellosis in Cattle (Disease-Free Area) Orders, 1968 to 1972, and this Order may be cited together as the Brucellosis in Cattle (Disease-Free Area) Orders, 1968 to 1973.

(3) This Order shall come into operation on the 31st day of May, 1973.

2. In this Order "the Principal Order" means the Brucellosis in Cattle (Disease-Free Area) Order, 1968 ( S.I. No. 112 of 1968 ).

3. The Principal Order is hereby amended by—

(a) the substitution in Article 18 of the following subparagraph for subparagraph (c) of paragraph (2)—

"(c) Where an animal referred to in paragraph (1)(b) which satisfies the requirement of paragraph (1)(b)(iii) is being moved into the area, the person in charge of the animal shall have in his possession a permit authorising the movement of the animal into the area.";

(b) the substitution in paragraph (2)(d) of Article 20 of "permit" for "certificate";

(c) the substitution in Article 24 of the following paragraph for paragraph (2):

"(2) An inspector of the Minister or an authorised officer may apply, or cause to be applied, to an animal any mark which he considers necessary for the purpose of identification and the owner or person in charge of the animal shall permit the application of such mark.";

(d) the insertion in paragraph (3) of Article 24 after "No person other than" of "an inspector of the Minister, or";

(e) the addition of the following paragraph to Article 24:

"(5) An inspector of the Minister, an authorised officer, or a veterinary surgeon authorised by the Minister to do so, may remove an approved ear-tag from a live animal and the owner or person in charge of the animal shall permit the removal and give such assistance as may be reasonably necessary for that purpose.".

4. The words "certificate or" in each place where they occur in Article 18 of the Principal Order are hereby revoked.

EXPLANATORY NOTE.

This Order by amending the Brucellosis in Cattle (Disease-Free Area) Order, 1968 makes additional provisions in relation to (i) the movement of certain classes of animals into and within the Brucellosis Disease-Free Area and (ii) the ear-tagging of cattle in the Area.
