BROADCASTING (RECEIVING LICENCES) (AMENDMENT) REGULATIONS, 1972.

I, GERARD COLLINS, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by Section 6 (1) of the Wireless Telegraphy Act, 1926 (No. 45 of 1926), as amended by the Wireless Telegraphy Act, 1956 (No. 4 of 1956), and with the consent of the Minister for Finance, hereby make the following Regulations:

1. (1) These Regulations may be cited as the Broadcasting (Receiving Licences) (Amendment) Regulations, 1972.

(2) The Broadcasting (Receiving Licences) Regulations, 1961 to 1971, and these Regulations may be cited together as the Broadcasting (Receiving Licences) Regulations, 1961 to 1972.

(3) These Regulations shall come into operation on the 1st day of September, 1972.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. In these Regulations—

" the Principal Regulations " means the Broadcasting (Receiving Licences) Regulations, 1961 ( S.I. No. 279 of 1961 );

" the Regulations of 1971 " means the Broadcasting (Receiving Licences) (Amendment) Regulations, 1971 ( S.I. No. 241 of 1971 ).

4. The Principal Regulations are hereby amended by—

(a) the substitution in the definition of " the Act " in Regulation 3 of " the Broadcasting Authority Act, 1960 (No. 10 of 1960), and the Wireless Telegraphy Act, 1972 (No. 5 of 1972) " for " and the Broadcasting Authority Act, 1960 (No. 10 of 1960) ";

(b) the insertion in the definition of " receiving licence " in Regulation 3 of " television broadcasts " after " only ";

(c) the substitution of the following paragraph for paragraph (1) of Regulation 7 (inserted by Regulation 4 of the Regulations of 1971):

" (1) A fee of seven pounds fifty new pence shall be paid on the grant of a receiving licence in the form set out in the First Schedule hereto."; and

(d) the substitution of the following for the First Schedule thereto (inserted by Regulation 7 of the Regulations of 1971):

This license is issued subject to the provisions of the Broadcasting (Receiving Licences)

Regulations, 1961 to 1972, and to any amendment thereof.

5. The following provisions of the Principal Regulations are hereby revoked, namely:

(a) Regulation 5 (2),

(b) Paragraph 1 (A) of Regulation 7 (inserted by Regulation 4 of the Regulations of 1971),

(c) Regulation 7 (2),

(d) Regulation 8 (4),

(e) Regulation 14, and

(f) the Second Schedule.

EXPLANATORY NOTE.

These Regulations amend the Broadcasting (Receiving Licences) Regulations 1961 to 1971, consequent on the abolition of the requirement to license sound broadcasting receivers from 1st September, 1972.
