SOCIAL WELFARE (INSURANCE INCLUSIONS AND EXCLUSIONS) REGULATIONS, 1971.

The Minister for Social Welfare in exercise of the powers conferred on him by section 3 and sub-sections (4) and (5) of section 4 of the Social Welfare Act, 1952 (No. 11 of 1952) hereby makes 'the following Regulations:—

1. These Regulations may be cited as the Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1971.

2. The Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1952 and 1968 and these Regulations shall be construed as one and may be cited together as the Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1952 to 1971.

3. In these Regulations "The Act" means the Social Welfare Act, 1952 (No. 11 of 1952).

4. Paragraph 7 of Part II of the First Schedule to the Act (inserted by Article (5) of the Social Welfare (Insurance Inclusions and Exclusions) Regulations, 1952 ( S.I. No. 373 of 1952 )) shall be amended by the deletion of sub-paragraph (e.

In accordance with section 4 (6) of the Social Welfare Act, 1952 a draft, sanctioned by the Minister for Finance, of these Regulations was laid before, and approved by each House of the Oireachtas. The necessary Resolutions were passed by Dail Éireann on 16th November, 1971, and by Seanad Eireann on 18th November, 1971.

EXPLANATORY NOTE.

The employment of sick or disabled persons by local or public authorities was hitherto exempt from insurance under the Social Welfare Acts (except for occupational injuries benefit) by the operation of the provision now deleted by these Regulations. This exemption is accordingly being ended by these Regulations and the category concerned will henceforth be insurable for all benefits under the Social Welfare Acts. The insurability of this category for occupational injuries benefit is in force since 1st May 1967.
